vacation which is due and payable within 60 daXs of the effective date of this resolution.

That access shall be maintained over the vacated az�a for the property at 1117 Hazel at the
request of the Department of Public Works. �

That a permanent utility easement shall be retained withi�e vacated area to protect the interest
of Comcast of St. Paul, Inc.. `\
That a permanent utility easement sha11 be retained over, under arid across the east 10 feet of the
the vacated area to protect the interest of Northern States Power Coiti,pany, d/b/a Xcel Energy.
5. That the petitioners, their successors and assigns agree to indemnify, def�nd and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or c� ms of any chazacter
brought as a result of injuries or damages received or sustained by any persorn,�persons or
property on account of this vacation ar petitioners' use of this property, includi� but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of
