BE IT RESOLVED, that, upon the petition of Western �e-Bank, as documented in Real Estate
Division File Number 07-2004, public properties hereinafter described are hereby vacated and
discontinued as public property:

westerly of and parallel to the southerly extension of the west line of Lot 10, said Block 1.
BE IT FURTHER RESOLVED, that the proper City officials aze hereby authorized and directed to
accept and to file in the Ramsey County Office of Records and Revenue the dedication of an a11ey
easement as required by and described in condition 2. below; and the sewer easement required by and
described in condition 3 below;
BE IT FURTHER IiESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of District
Energy St. Paul, Inc. and District Cooling St Paul, Inc., the Department of Public Works and the Saint
Paul Regional Water Services, made a part hereof by this reference and filed in the office of the City
Clerk of Saint Paul, the City, far itself and on behalf of these corporations and departments, waives the
right to the utility easements in the vacated area described above.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner, their successors and assigns, sha11 pay $1,200 as an administrative fee for this
vacation which is due and payable within 60 days of the effective date of this resolution.
That, the petitioner, their successors and assigns, shall provide a permanent public alley easement
from the existing alley north to Sherburne Avenue across the following described property:
the east 20.00 feet of Lot 11, Block 1, Syndicate No. 1 Addition.

That the petitioner shall construct the public sewer structures required by the Department of
Public Works to properly drain the ailey out to St. Albans Street, and shall dedicate the public
sewer easement necessary to provide for the construction and maintenance of said storm sewer
facilities.
That the petitioner shall construct, to the satisfaction of the Department of Public Works under
an ordinance pemut issued by Public Works Street Engineering, the new portion of alley in the
alley easement described in condition #2 above.
That the petitioner shall be responsible for the reconstruction (including but not limited to, costs
for new curbs, sidewalks, boulevazds, storm drains, and signs, a11 to the satisfaction of the
Deparnnent of Public Works) of both ends of that part of the alley hereby vacated, to properly
eluninate the appearance of a public thoroughfare.
That, until the existing street lighting facilities within the vacated area have been relocated, at the
expense of the petitioner, to a location and in a manner approved by the Department of Pubiic
Works, a permanent utility easement shall be retained on, over, under and across the west 22.00
feet of the vacated area to protect the interest of the Department of Public Works. Any
development or use of the property sha11 be subject to the following conditions:
a. No buildings, stnxctures, trees or any temporary structure, material starage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
wiil be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written permission from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

No change in surfacing within the easement area will be permitted without written
permission from the Department of Public Warks.
e. The petitioner, its successors and assigns shall indemnify, defend, and save hannless the
City of Saint Paul, its officers, agents, employees, and servants from a11 suits, actions, or
claims which shall arise from any injuries or damages received or sustained by any break
in any service pipe or connection in said reserved easement arising out of or resulting
from any action or negligence of the petitioner, its employees, agents, or business
invitees.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Corporation.

brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claun brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
16 11. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
17 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
18 and sha11, within the period(s) specified in the terms and conditions of this resolution, comply in

The Department of Public Works has reviewed the above requested vacation and has no
objections subject to the following conditions.
1. That a permanent easement in favor of the Department of Public Warks shall be retained on,
over, under and above the west 20 feet of the vacated area to provide for the existing street
lighting faciliries. {Include easement restrictions)
2. That a permanent 20 foot wide alley easement shall be dedicated to the City of Saint Paul, in a
form acceptable by the Department of Public Works, over the following described area:
The east 20 feet of Lot 11, Block 1, Syndicate No. 1 Addition
3. That the petitioner shall be responsible for the construction of the new alley referenced in the
above condition #2, to the satisfaction of the Department of Public Works, under an ordinance
permit issued by Street Engineering.
4. That the petitioner shall be responsible for the reconstruction of both ends of the vacated area
to eliminate the appearance of a public thoroughfaze, including, but not limited to, ali costs and
expenses for the removal or reconstruction of curbs, gutters, sidewalks, boulevards, drainage
structures, and signs.

LIEP has no objections to the vacation of the alley.
The applicant is also propossing to dedicate a new ailey out to Sherburne. I think there has been some discussion about how
wide the new alley should be and how it will drain. I am not sure if that has any impact on the proposed vacation.
