2 BE IT RESOLVED, that upon the petifion of the Housing and Redevelopment Authority of the City of
3 Saint Paul, as documented in Real Estate Division File Number 26-20Q3, public properties hereinafter

BE IT FURTI3ER RESOLVED, that subjeci to the herein stated exceptions and with the
accompanying Utilitq Easement Certificates of Intended Non-Use, filed voluntarily on behalf of, the
Qwest Corporation, District Energy St. Paul, Inc. and District Cooling St Paul, Inc., and Saint Paul
Regional Water Services, made a part hereof by this reference and filed in the office of the City Clerk of
Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the right to
the utility easements in the vacated area described above.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paui L.egislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $1200 as an administrarive fee for this
vacation which is due and payable within 60 days of the effective date of this resolution.
At the request of the Departsnent of Public Works and the Office License, Inspection and
Environmental Protection, the petitioner's, their successars and assigns shall :
a) Dedicate a permanent public alley easement a minimum of 20 feet wide. It shall run from the
remaining existing alley, south to Aurora Avenue. The petitioner shall submit a legal
description for the location of the new alley to be dedicated and if necessary, adjust the
description of the alley vacation accordingly. The petiuoner shall construct the new alley to the
satisfaction of the Department of Public Works under an ordinance pernut issued by Public
Works Street Engineering.
b) The petitioner shall be responsible for the reconstruction of both ends of the vacation area,
which will be necessary to properly eliminate the appearance of a public thoroughfaze, including
but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and signs, a11 to the
satisfaction of the Departrnent of Public Works.

T'hat a permanent utility easement shall be retained within the vacated area to protect the interest
of Northern States Power Company, d.b.a. Xcel Energy (Gas & Electric) .
That a pertnanent utiliry easement shall be retained within the vacated area to protect the interest
of Comcast of St. Paul, Inc..
At the request of the Department of Planning and Economic Development, petitioner, its
successors and assigns shall maintain proper access on the remaining portion of the aliey for
businesses immediately west of the vacated azea.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or daznages received or sustained by any person, persons or
property on account of this vacaUOn or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liabilitp arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
23 7. That the petitioners, their successors and assigns sha11, within 60 days of the effective date of this
24 resolution, file with the City Clerk an acceptance in writing of the condirions of this resolution
25 and shall, wittun the period(s) specified in the terms and canditions of this resolution, comply in
26 all respects with these terms and conditions.

I recommend a public hearing before the City Coimcil be held on Aprll 28, 2004 to consider
the petition of Richard Adams.
The purpose of this petition is to vacate Jessamine Avenue East from Hazel Street to the west, to the
west property line of the Chiclgo, St. Paul, Minneapolis and Omaha Railroad.
The purpose of this vacation is for greenspace.
This property is located in City Council District 6, Planning District 2.

The Aepartment of Public Works has completed a review of the above referenced vacarion
proposal and has no objecfions to their proposal subject to the following requirements:

The purpose of this alley vacation is to develop a new library and new housing.
