2 BE IT RESOLVED, that upon the petition of the Ken Lang, as documented in Real Estate Division File
3 Number 18-2003, pubiic properties hereinafter described aze hereby vacated and discontinued as public

The alley between Block 11 and Block 13, both in Burlington Heights Division No. 2
from the southerly line of Oakridge Street to the easterly line of Mystic Street.
10 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
11 Saint Paul Legislative Code as amended, and to the following condifions:

13 1. That the petitioner's, their successors and assigns shall pay $600 as an administrative fee for this
14 vacation which is due and payabie within 60 days of the effective date of this resolution.

That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Northern States Power Company, d.b.a. Xcel Energy so as to maintain existing facilities .
That a permanent uUlity easement shall be retained within the vacated azea to protect the interest
of Qwest Communications.
That the petitioners, their successars and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from ali suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
properiy on account of this vacation or petitioners' use of this property, including but not limited
to, a claun brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.

I have reversed my opposition to the vacation, based upon a request from a
neighboring parcel owner to vacate part of Groveland Ave., north of
Oakridge. I intend to approve the Groveland request, which is in an area
already surrounded by development and improved streets, and believe that
denying the owners of 2050 and 2070 Oakridge a similar opportuniry to
maximize their parcels would be difficult to defend. I will, however,
continue to review vacation requests in the Point Dougias corridor from a
perspective that the City should be reluctant to release public
right-of-way that may be required for future utility or access routing and
currently serves as open space.
