WHEREAS, Pursuant to resolution, C. F. 235664, approved November 7, 1967, a public hearing was duly held on Thursday, November 16, 1g67, on Thursday, November 30, 1g67, and on Thursday, December 28, 1967, before the Council of the City of Saint Paul, said hearings pertaining to the condition of the structure located at 435 North Gro�to Street, Saint Paul, Minnesota; and WHEREAS, Upon the facts presented at the said hearings consieting of ghotographs, inapection rep�rrts aact� t�- tion `of the Citq Archit�t; it is fou�rd an� �et�rs�i.ns.d` by the. . City Council that according to the records and files in the office of the �egister of Deeda, the laat record owner of the above—described property is Mabel Schmitt, there is an apparent unrecorded interest of Frank M. Smith; and that there �,re no other lien holders o� record; and that it is further determined that the above—described building consf,itutes a hazardous build— ing within the definition of Minnesota Statutes Section 463. 15 for the following reasons: �o APPROv t. Unless such corrective action is taken to comply with • this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building will be made to the Ramsey County District Court. 3. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably inter— fere with the razin and removal of this building shall be removed within ten �10) days from the entry of judgment; and if n.ot so removed, the City of Saint Paul shall remove and dis— pose of sueh personal property and fixtures as provided by law. 4. The building is standing vacant, apparently abandoned and subject to entry by unauthorized persons; b. The exterior of the building is in poor condition in that the imitation brick siding has been pulled off in several places, the mortar joints of the chimney are eroded, sections of the wood cornice trim are missing and the cement block �oundation is eroding; c, There is a large structural crack in the basement foundation wall, the con- crete floor slab in the basement is deteriorated, the basement window frames are badly rotted, the stairway from the basement is dangerous due to different heights of the risers and absence of a railing; d. The gypsum wall material is missing from the walls on the main floor of the • building, plaster walls are cracked, loose and sections have fallen off, the roof leaks and the floor has buckled; e. The building is unfit for human habitation in its present condition and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; . f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation and inadequate maintenance and abandonment; � . , 2�(��4�� Page 3. now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the foregoing findings of the City Council , the Council of the City of Saint Paul does hereby make the following Order: ORDER 1. The owner of the above-described building shall make the same safe and not detrimental to the public health, safety and welfare by havin� the sa�d building razed and the materials there�rom removed from the premises within thirty (30) days from the date of the service of this Order or, in the alternative, begin to correct the hazardous conditions within thirty (30) days �rom the date of the service of this Order to correct the hazardous conditions by doing the following: a. Remove all paper and other combust- ible materials from the building and securely close and keep closed all doors , windows or other openings in the building; b. If the building is to be used for human habitation, all of the above defective conditions must be corrected and the building corrected so as to comply with and meet the Saint Paul Housing Code and the Saint Paul Building Code requirements, and that the owner submit a list of intended corrections regarding the structural condition of the building, electrical and heating system, together with a schedule for the completion of the rehabilitation program and that the owner apply for the necessary permits in the office of the City Architect within the thirty (30) days imposed herein. •r- � � . � � i • � ' �� II����� �� � ����G,�aP,u ������� � �6' 4 [1� �J/ + V ��. ` � t V r ' • � �. � �/��
