EREAS, the Office of the Corporation Counsel has
certified in writing that it is in doubt as to who is entitled
to the award of damages, in the amoun.t of �200.00, for the
taking of property described as follows:
An easement in the land necessary for the slopes, cuts
and fills, including right of removal of lateral sup-
port from subject land or remainder thereof occasioned
by excavations thereof or construction of slopes in
the grading and surfacing with bituminous material of
Cottage Avenue from Galtier Street to the West line of
Farrington Street, as opened, in the following: Except
South 10 feet for Avenue; The South 135 feet of part of
Lot 9, Wolcott ' s Addition to Cottage Homes, West of the
extended West line of Matilda Street a,nd the South 400
feet of Lot 1 , Cottage Homes, said easement being in
the land along the South line of the tract described
a.nd immediately adjacent to the North line of Cottage
Avenue as widened and being of variable width but not
to exceed a maximum width of 7.0 feet , according to the
plat thereof on file a.nd of record in the office of the
Register of Deeds in an.d for Ramsey County, Minnesota;
said award having been confirmed by Council File No. 225228,
approved September 15 , 1965; now, therefore , be it
RESOLVED, That a warrant be drawn for said a.mount of �200.00,
payable to Frederick L. Weston, Clerk of District Court, Second
Judicial District, Ra,msey County, Minnesota, for the party or
parties entitled thereto.
