1 WHEREAS, the City of Saint Paul ("Cit}�') desires to acquire a Permanent Right-of-Way Easement and
2 a Temporary Conshuction Easement on, over, under and across a tract of land owned by the Won Hwae
3 Huh and Jean Sook Huh ("Owners"), located at 301 McKnight Road South, Saint Paul; and

5 WHEREAS, said easements, being in the County of Ramsey, State of Minnesota, are described as
6 follows:

9 That part ofLot 2, Block 1, SHAMROCK PLAZA, Ramsey County, Minnesota, lying northeasterly
10 of the following described line: Beginning on the north line of said Lot 2, 10.00 feet west of the
11 northeast corner of said I,ot 2, thence southeasterly intersecting the east line of said Lot 2,10.00 feet
12 south of the northeast corner of said L,ot 2 and there said line terminates.

WHEREAS, the Owners haue executed a Dedication of Easement agreement to convey said permanent
easement to the City (attached as Exhibit "A") and a Temparary Construction Easement to convey said
temporary easement to the City (attached as Exhibit "B"); and
WHEREAS, said easements are necessary for the construction by the Ramsey County Public Works
Department of a new traffic signal and left turn lanes at the intersection of McKnight Road and Lower
Afton Road; and
WHEREAS, the City has agreed to pay the Owners Two Thousand Four Hundred Dollars ($2,400.00)
for said easements, this being a fair and reasonable value as determined by an appraisal; and
WHEREAS, the Valuation & Assessment Engineer has recommended the purchase of said easements
30 at the agreed-upon value; now, therefore be it

32 RESOLVED, that the Saint Paul City Council accepts said Dedication of Easement agreement and
33 Temparary Construction Easement and directs and authorizes the proper City officials to pay $2,400.00
34 to Won Hwae Huh and Jean Sook Huh for the purchase of said easements, said amount to be charged to

DEDICATION OF EASEMENT
FOR STREET PURPOSES
Won Hwae Huh and Jean Sook Huh
Grantor(s), for good and valuable consideration, to them in hand paid and the receipt of
which is hereby acknowledged, does hereby grant, bargain, sell and convey to the City of Saint
Paul, a municipal corporation of the State of Minnesota, its successors, and assigns, as Grantee, a
permanent easement for street purposes to open, widen and extend McKnight Road and Lower
Afton Road over, under and across the following tract of land being in the County of Ramsey,
State of Minnesota, described as follows:
That part of Lot 2, Block 1, SHAMROCK PLAZA, Ramsey County, Minnesota,
lying northeasterly of the following described line: Beginning on the north line of
said Lot 2, 10.00 feet west of the northeast corner of said Lot 2, thence southeasterly
intersecting the east line of said Lot 2, 10.00 feet south of the northeast comer of said
Lot 2 and there said line terminates.
To have and to hold the same forever. The Grantor does covenant that it is well seized in fee
of the land and premises aforesaid, and has good right to sell and convey the same free of all
encumbrances.
That Grantor also covenants that the above granted easement is in the quiet and peaceable
possession of the Grantee. The Grantor will warrant and defend against aii persons iawfuliy
claiming the whole or any part thereof, subject to encumbrances, if any, hereinbefore mentioned. It
is intended and agreed that this agreement shall be a covenant running with the land and shall be
binding to the fullest extent of the law and equity for the benefit of the public. It is further intended
and agreed that this agreement and covenant shall remain in effect without limitation as to time.

TEMPORARY CONSTRUCTION EASEMENT

THIS INDENTURE, made this day of 2004, by and between the
Won Hwae Huh and Jean Sook Huh their successors and assigns, Grantor(s), and the Citv of Saint Paul ,
a municipal corporation under the laws of the State of Minnesota, its successors and assigns, Grantee, for good
and valuable consideration, to the Grantor it in hand paid and the receipt of which is hereby aclmowledged, does
hereby grant, bazgain, sell and convey unto Grantee a Temporary Construction Easement over, under and across
the real property described as:
The easterly 5.00 feet of I.ot 2, Block 1, SHAMROCK PLAZA, Ramsey County, Minnesota; and
The northerly 5.00 feet of L.ot 2, Block 1, SHAMROCK PLAZA, Ramsey County, Minnesota.
The easement boundaries and area are shown on the attached map (Exhibit "A").
It is further understood and agreed that the Grantor, for the above consideration, does hereby convey to the
Grantee the above described easement for certain purposes including but not limited to entry, operation, sloping,
grading and the clearing and storage of materials in conjunction with and during the construction of a traffic signal
at the intersection of McKnight Road and Lower Afton Road by Ramsey County.
This easement shall have expired on the 31s` day of December, 2004.

Ramsey Counry is conshucting a new signal and left tum lanes at this intersection this summer. They have asked the Ciry to acquire
the necessary easement rights on properties on the Saint Paul side of McKnight Road for this project.

residents in the area, including Saint Paul residents.
