WHEREAS, the City of Saint Paul ("Cit}�') desires to acquire a Temporary Construcrion Easement on, over,
under and across a iract of land owned by the Glen Dawn Townhomes Association ("Owner"), located at 2214-
2234 Lower Afton Road, Saint Paul; and
WHEREAS, said easement, being in the County of Raxnsey, State of Minnesota, is described as follows: The
northeriy 5.00 feet of the easterly II S.QO feet of Lot 1, Block 5, GLENDAWN TOWNHOMES, Ramsey County,
Minnesota;and
WHEREAS, the Owner has executed a Temporary Construction Easement to convey said easement rights to the
City (attached as E�ibit "A"); and
WHEREAS, said easement is necessary for the construction by the Ramsey County Public Works Department of
a new h�affic signal and left tum lanes at the intersection of McKnight Road and Lower Afton Road; and
WHEREAS, the City has agreed to pay the Owner Five Hundred Dollars ($500.00) for said easement, this being
a fair and reasonable value as deternuned by an appraisal; and
WHEREAS, the Valuarion & Assessment Engineer has recommended the purchase of said easement at the
agreed-upon value; now, therefore be it
RESOLVED, that the Saint Paul City Council accepts said Temporary Construction Easement and directs and
authorizes the proper CiTy officials to pay $500.00 to the Glen Dawn Townhomes Associafion for the purchase of
said easement, said amount to be charged to Activity Code: C04-2T830.

TEMPORARY CONSTRUCTION EASEMENT
THIS INDENTL7RE, made this �/ S day of (�'J �2G�1 , 2004, by and between the
Glen Dawn Townhomes Association their successors and assigns, Grantor(s), and the Cit� of Saint Paul .
a municipal corporation under the laws of the State of Minnesota, its successors and assigns, Grantee, for good
and valuable consideration, to the Grantor it in hand paid and the receipt of which is hereby aclaiowledged, does
hereby grant, bargain, sell and convey unto Grantee a Temporary Construction Easement over, under and across
the real property described as:
The northerly 5.00 feet of the easterly 115.00 feet of Lot i, Block 5, GLEN DAWN TOWNHOMES, Ramsey
County, Mimiesota.
The easement boundaries and area are shown on the attached map (Exhibit "_A").
It is further understood and agreed that the Grantor, for the above consideration, does hereby convey to the
Grantee the above described easement for certain purposes including but not limited to enhy, operation, sloping,
grading and the clearing and storage of materials in conjunction with and during the construction of a traffic signal
at the intersection of McKnight Road and Lower Afton Road by Ramsey County.
This easement shall have expired on the 31 �` day of December, 2004.

Ramsey County is conshucting a new signal and left tum lanes at this intersection this suminer. They have asked the City to acquire
the necessary easement rights on properties on the Saint Paul side of McKnight Road for the project.

residents in the azea, including Saint Paul residents.
