RESOLVED, Upon the pertinent appeal, under the Zoning
Code, by Memorial Lutheran Church, owner of the subjeet premises,
zoned in "A" Residence District, under said Zoning Code, des-
cribed as Lot 19 and that part of the north-south alley lying
between the extended northerly line of Lot 19 and the north line
of Maryland Avenue, all in Block 8, Phalen Heights Park, according
to the plat thereof on file and of record in the office of the
Registrar of Titles in and for Ramsey County, Minnesota, that the
provisions of said Zoning Code, in respect to buffer requirements,
hereby are determined and varied, in their application to said
real estate, as and to the extent necessary therefor, and that
the required eight foot buffer from residential property be
relaxed to four feet on the property to be used as a parking
facility for chureh activity, all in accordance with plana there-

appellant-permittee, and its successors in interest, shall make
due compliance with all applicable ordinances, state statutes and

Dear Sir:
This is written in response to the appeal of the Memorial Lutheran Church
to relax the required eight foot buffer from residential property, and to
relax the required setback from the front property line on property located
on the north side of Maryland Avenue between Earl and Frank Streets. This
property is further described as Lot 19 and that part of the north-south
alley lying between the extended northerly line of Lot Z9 and the north
line of Maryland Avenue, all in Block 8, Phalen Heights Park.
The applicant proposes to use the property as a parking facility for
church activity. However, the Zoning Code requires that for parking lots
with a capacity of ten or more cars, an eight foot buffer should be pro-
vided on any side adjoining residentially zoned property. It also provides
that parking spaces be designed to be no closer than one-half the estab-
lished building line setback. In this case, the required setback for the
parking lot would be 12 feet. The applicant proposes to relax the eight
foot buffer to four feet, and the 12 foot setback to 2.5 feet.
This matter was considered at the October 5, 1967 Board of Zoning meeting.
The staff reported that the area is zoned "A" residence except for the
northwest, southwest, and southeast corners of Earl Street and Maryland
Avenue which are zoned commercial. The lot is presently vacant. Memorial
Lutheran Church is to the west and a single-family dwelling is to the east.
It was the findings of. the Board ' ^+- the requested relaxations of the
Zoning Code requirements would n �iinental to surrounding properties
inasmuch as the parking lot wou ���t��,�°�v`�n Sundays.
Therefore, the Board of Zoning ���y a�o�b� v�, request to

respectfully make a zoning apgeal to relax the e�,ght (8) foot buffer requirement
and to relax the set back from Maryland Avenue to two and one half (2 1/2) feet
required in Legislative Code Chapter 64.03, paragraph J.

We desire to establish a new parking lot on a vacant lot and recently vacated
portion of alley abutting it on the north side of Maryland Avenue between
Earl and Frank Streets. The legal description of the property is Lot 19,
Block 8, in Phalen Heights Park and the description of the vacated alley
3ns "that part of the north and south alley in Block 8, Phalen Heights Park,
e''�lying between the extended northerly line of Lot 19 and the north line of
Maryland Avenue". Vacation of alley was adopted by the City Council on August 3, 1967.
The property is presently vacant, we desire to alleviate a very serious parking
problem by establishment of a parking lot on these properties. Relaxation of
the aforementioned requirements will provide more, safer and better parking
facilities, and we beleive that it will be more satisfactory and beneficial to
other abutting property and also other nearby properties, and also to the
good of all concerned.
Flow of traffic in this vicinity is extremely heavy. The establishment of as
much off street parking as is possible for use �in connection with church services
and activities of Memorial Lutheran Church should be beneficial to all concerned.
The relaxing of normal requirements will add to number of parking facilities
available.
We tlserefore respectfully request approval of this appeal and approval of the
plan proposed herewith.
