Ordinance amending Chapter 60 of the
Saint Paul Legislative Code; providing for
regulation o� outdoor advertising along certain
advanced speed arteries in the City of Saint Paul.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ghapter 60 of the St. Paul Legislative
Code, as amended, be and the same is hereby further amended
as follows :
60. 19A. ADVERTISING DEVICES ALONG ADVANCED SPEED
ARTERIES.
(1) PURPOSE. For the purpose of this section, it is
hereby deelared to be the policy of this city and in the public
interest to:
(a) p�avide for visibility along advanced speed arteries,
connecting roads and highways;
(b) prevent unreasonable distraction of operators of
motor vehicles on such arteries ;
(c) prevent confusion with regard to traffic lights�
sign.s or signals or which otherwise interferes with the effective-
ness of traffic regulations ;
� (d) �promote the comfort and well-being of users of road-
ways in �cenic areas; and -
(e) preserve and enhance the natural scenic beauty or
the aesthetic features of roadways in scen.ic and adjacent areas.
(2) DEFINITIONS. For the purpose of thi� aection, the
following definition.s are applicable :
(a) ADVANCED SPEED .ARTERY--A limited aecess freeway or
other road upon portions of which speeds of 40 miles per hour
or greater are permitted and which �,s -located within one of the
Advertising Device Control Seg�ents cxeated hereunder.
(b) ADVERTISING DEVICE--Any outdoor sign, display, device,
fig�.re�painting, drawing, mes �.ge, placard� poster, billboard,

(i) signs required by law;
(ii) signs advertising the sale or lease of the property�

(iii) signs indicating the name of a business or profession
which is conducted on the premises on which the sign is located, �
including, if desired, a description of the goods produced or
services rendered on such property, provided such signs comply
with the requirements of this section regarding illumination
and with other ordinances respecting their construction and
placement.
(c) ERECT--Erect means to construct or allow to be
constructed., build, raise, place , affix, create , paint, or
draw, or in any way bring into being or establish.
(d) MAINTAIN--Maintain means to preserve, keep in repair,
continue, replace or allow to exist. '
(3) ADVERTISING DEVICE CONTROL SEGMENTS CREATED. There
are hereby created Advertising Device Control Segments 1 and 2,
shown on the official map which accompanies this ordinance
and is hereby declared to be a part hereof.
No advertising device which is visible from any part
of the main traveled roadway of an advanced speed artery running
through the segment may be erected or maintained anywhere within
Advertising Device Control Segment 1.
Advertising devices may be erected or maintained which
are visible from the main traveled roadway of an advanced speed
artery run.ning through Advertising Device Control Segment 2
provided they meet the following requirements :
(i) the parcel on which it is proposed to erect or
maintain the device is otherwise zoned for such use ;
(ii) all other provisions of this ordinance or any
other regarding spacing, size, illumination, construction, or
other features are complied with.
(4) SIZE OF ADVERTISING DEVICES.
(a) No advertising device shall occupy more than 750
square feet exclusive of ornamental apron or base supports,
provided that any rectangular advertising device may contain
extensions , cutouts , or top lettering which occupy a total area
not in excess of 50°�0 of the area of the basic advertising device,
and form an integral part of the design thereof, and provided
further that no such extension, cutout, or top lettering may
project more than 6 feet from the top, 18 inches from either
side, or 15 inches from the bottom of the basic rectangular
advertising message.

The area of an extension, cutout, or top lettering shall
be deemed to be the area of the smallest rectangle into which
such extension, cutout, or top lettering will fit.
(b) Structures upon which advertising messages are located
may contain more than one message per facing, and may be placed
back to back or in a vee , but the total area of the advertising
device facing traffic in any one direction shall not exceed the
limits permitted by (a) .
(c) No advertising device shall be more than 50 feet in
- height, measured from the ground or roof on which located, except
that where an advanced speed artery faced by the device is ele-
vated above the surface on which the device is placed, the device
may extend 25 feet higher than the nearest road surface of the
advanced speed artery.
(5) SPACING OF ADVERTISING DEVICES. Advertising devices
otherwise permitted hereunder shall be spaced as follows :
(a) Advertising devices may not be located in such a
manner as to obscure or otherwise interfere with the effective-
ness of an official traffic sign, signal, or device , obstruct
or interfere with the driver' s view of approaching, merging
or intersecting traffic.
(b) No device which is visible from the main traveled
roadway may be placed within 660 feet of any other device
which is visible from the roadway and which is located within
the control segment, unless the devices are on opposite sides
of the advanced speed artery involved.
(6) LIGHTING AND MOVEMENT. No advertising device shall
display any moving parts , nor shall it be illuminated with any
flashing or intermittent lights . All devices shall be shielded
to prevent any light to be directed at oncoming traffic in such -
brilliance as to impair the vision of any driver. No device
shall be illuminated in such a fashion as to interfere with or
obscure an official traffic sign or signal.

('7) NONCONFORMING USES. All advertising devices which
do not conform to the requirements of this section regarding
size , spacing, or illumination shall be brought into conformance
upon the adoption of this ordinance. Any advertising device
which is in violation of this section solely because it is
located within Control Segment 1 as of the date this ordinance
becomes effective may be maintained as such, kept in. ordinary
repair, and the advertising message thereon periodically re-
placed.
(8) RELATION TO OTHER SECTIONS. Nothing contained in
this section shall be construed to permit the erection or
maintenance of a.ny advertising device or structure which is
prohibited by the zoning classification applicable to the
parcel upon which the device is proposed to be located or
which is otherwise prohibited, restricted,or limited by any
other provision of law or ordina.n.ce.
Section 2 . This ordinance shall be deemed a part of the
St. Paul Legislative Code and shall be incorporated therein and
given an appropriate number at the time of �the next revision of
said Legislative Code.
Section 3. This ordinance shall take effect and be
in force thirty days after its passage, approval and publication.

are hereby created advertising Device Control Segments 1 and 2,
shown on the official map which accompanies this ordinance
and is hereby declared to be a part hereof.

advertising devicesr/per facing and may be pla ' d double faced,

as to prevent beams or rays of 1'ight from being directed at any
portions of the traveled ways of `the roadway and which are of
such intensity or brilliance as ta cause glare or to impair
the vision of the driver of any motor vehicle , or which other-
wise interfere with any driver' s operation of motor vehicle .
(c) And no advertising 'device shall be so illuminated
that it interferes with the e�fecti�eness of, or obscures an
official traffic sign, device or sign.al .

restrictions :
(1 ) They must be located oi1 prope r.ty otherwise zonecl for
the r,urpose , th��.t is commercial or industrial property;
(2) They cannot exceed 1200 square �eet in area nor extend
higher th�n 50 f.ee�L above the ground or roof on which they are

You each received yesterday a memorandum from Mr. J.
Douglas Kelm asserting certain insufficiencies in the approval
as to form of the billboard control ordinance.
The memorandum asserts that the amendments passed by
the Council on February 20 "revised the wrong sections, for
the most part, of the original proposal . "
It is not frequent that an ordinance of the complexity
of the billboard ordinance reaches the council , and it would
have been extremely difficult to follow the sometimes-used
procedure of substituting an entirely new ordinance for the
one originally introduced.
The amendments to the ord�nance were prepared in sec-
tionalized form, with three intemal sections dividing the
amendments . Mr. Kelm is apparently taking the referent of
these internal section divisions, which relate only to the
amendment itself, as being the sectional division of the
ori inal ordinance . Correctly understood, the aunendments
re a e o e proper sections of the ordinance, are in proper
form, and were in my judgment properly adopted on February 20.
Section 117 of the Charter requires that , prior to
final adoption, an ordinance must remain on file in the office
of the City Clerk for public inspection for at least one week,
"complete in the form in which it is finally passed. " I am
advised by the City Clerk that the original ordinance , to-
gether with the amendments adopted by your honorable body
February 20, were so available for inspection. It is my
opinion that the ordinance meets the requirements of Section
117 notwithstanding the amendments were not physically amal-
gamated into the document itself during the time it was on
file in the City Clerk' s office .
It is accordingly my conclusion that it wo uld be proper
for the Council , if it so desires , to finally pass the billboard
ordinance today, Tuesday, February 27, 1g68. In any event, any

asserted improprieties in the adoption process can be cured
by laying over final adoption for a week, inasmuch as the
ordinance is now on file with the amendments fully amalgamated.

Gentlemen:
As per Council�s request of January 12, 1968, the City Planning
Board of Saint Paul reviewed the Ordinance regulating outdoor
advertising, referred to above, at its regular monthly meeting
on January 26, 1968 and again at a special meeting on February 9,
1968.
At the special meeting on February 9, 1968, the Planning Board moved
\� the adoption of the Ordinance as represented by Council Resolution
��236622 with those changes reco�anended in the Planning Board staff
report, dated January 22, 1968.
Please find attached copy of the Planning Board staff report,
referred to above, along with a copy of the original map considered

This "Outdoor Adv�rtising" ordinance has been transmftted by the City Council
to the Planning Board £or review and comment at Che January meeting of tht
Board.

The Planning Board staff recommends this ordinance to the Planning Board,
with certain modiffcatione. �he seaff believes that this ordinance is a
positive step for�aard in improving the �menity characteristics of the Saint
Paul urban envir�onment. The steff further believes that it is not neces-
sary, or desirable to exclude outdoor advertising devicea totally from the
urban landscape> It is better to control their use by restricfing the.ir
location to non-reaidential areas, and to place certain limitations on the
size and placement of the structureao
Ttze ataff believes tha� the following modifications ahould be made in the
ordinance to strengthen it and make it a better ordinance from the stand-
point of the public benefita The recoumiendations for improvement are as
followa:

The 1,200 square faot maximum area for one advertisiag device is much

feet which includes border and trim but not supporting structureso An

B.. PLACEMENT:
The staff believes that no advertising device be placed on the top of
a building and that a 40' limitation on height be set from the ground

�ldvertising is the "LITE BLOOD" of the American economy. Outdoor
advertising is an important part of advertising. ?Karketing is done
through advertising. How would the new products developed out of
modern technology be made available to the public if it were not for
advertising?
Outdoor advertising (I prefer the words "ontdoor advertising" in place
o_f. billboards) is neither sinful nor immoral. If objections have arisen
because some firms have not kept +heir signs in gooc3 repair - these
objections can be corrected by invitir..g the Outdoor l�dvertising Institute
to propose to government minimum standards which are acceptable to both
the public and the advertising indus�ry.
Outdoor advertising serves a needed funetion. As an example, I just
returned from Florida. G]hen it came time to find a motel - I was watchin�
for outdoor advertising to learn where the next FI�TE motel would be and
how far I would have to drive. Some advertising was a long distance back
from the highway. The signs of necessity had to be immense - they had to
be well lighted. These immense signs certainly cost more money to build,
were more difficult to read and cost substantially to be kept well lighted.
Also remember - these added costs had to be passed along to the public.
On the other hand - had it been Iawful to be closer to the highway - the� could
have been smaller and used 3 M SCCIrCH LIGHT.
Business a_nd labor benefit fror� outdoor advertising. Labor builcls these
after an advertisirg agenc�T seils them and labor maintair.s them - businegs
benefits b�r its marketing power, the public receives the r�essage, the land-
lord receives rent from his real estate and the governmer� receives taxes
on all incoMe received fror� both business and labor through income tax.
It appears to be in extrer�el�r poor taste for Sair_t Fau1 - the hor�e office
of 3�i Company - who manufacture SCOTCH LITE - to pass any form of ordinance
which restrict outdoor advertisir.g. 3T-. Cor�pariy employs thous�nds of wage
earners and pa;�s fantastic taxes on their Real Estate to Saint Pau1 ar�d
F�amsey Count�r, without mer_tionin� Federal and State Corporation Income �ax.

I feel EVERYONr' woulc ber_efit if Saint Paul would initat;e action
whereby outdoor advertisir.g would change their public ima�e to one
which serves and demonstrates a public need.. I speak of 3P�1 Cot�pany
referrin� to its local good - but act,ually the jobs created by outdoor
advertising are tremenc?ous, NaTIO?`1T,dmE. Everythin� should be done to
further develope the econo:�,y of America and not act as a deterent. T�Ihen
jobs are needlessly legislated away from an induatry - that is a deterent
to our American economy. It is a certaint� - the Outdoor Advertising
Companies would be most able to draft regulations which would upgrade
the prestige of outdoor advertising - if asked to dc so or just given
a chance.
It is not difficult to find fault with ar�ything - if fault finding is
the goal.
We hear so much about povert;�, the poor people, the need for more tax
money. Faced with these facts - what axe we doin.g? We are askir�
government to enact UNREA.SONABLE restrictions on an industry which of
necessit}r will have to lessen their work crews and thereby add to ttxi
employment and less tax dollars. Asking an advertiser to keep his message
660 feet away from a potential customer - is like a husband telling his
wife she may go shopping but let your mone�r, check book and cha.rge plates
home.
If instead this problem were approached with a positive view, REASOTIABLE
standards could be established which would not curtail the industry,
wculd not place families on the unemployznent rolls and instead could
give the security which is so sorely needed.
There are ma.r�y absolutely beautiful CUTDOOR SIGr�TS all over America
which stand as evidence that OUTDOOR SIG"�dS can be beautiful if that is
what the public wants. In fact, instead of banning outdoor advertising -
BEAUTIFUL and P'�ANIPdGFUL advertising should be encouraged.
I sincerely believe everyone will benefit by OUTDOOR AWEFTISIP�'G whether
it be the motorist, labor, business, goverrunent or the public. Let us
consider both sides of the picture. Let us be PRO and not AT1TI American
eccnomy.
I offer these suggestions in the sincere hope that serious thought be
given this very serious subject.

SUBJ: Billboard Control Ordinance '
On January 25, 1968, the Merriam Park Community Council directed me to
appear in behalf of the Community Council before the City Council and other
public agencies for the purpose of obtaining complete prohibition of general
advertising billboards along our freeways.
The Merriam Park Community Council is a formal federation of community organ-
izations each of which has named a representative to sit on our council.
Present at the January 25th meeting were representatives of the following:

First Trinity Methodist Church Merriam Park Residential Assoc.

St. Mark's Parents' Club Merriam Park Library Assoc.
Merriam Park Parents' Club Good Counsel Cancer Home
The vote favoring the total ban of billboards along our freeways was unanimous,
as was the vote directing me to represent that position.
Fortunately, the Council has already established a city policy which leaves no
room for anything but very strong controls. On April 4, 1967, the Council
directed appropriate city officials "to enter into an agreement with the
Minneapolis Planning Board and the State Highway Department to work toward
making Highway No. 94 a parkway." Obviously the city's policy is not intended
for the east-west freeway alone. The resolution was so worded only because
it's the only freeway or expressway specifically shared by St. Paul and
Minneapolis. Later in the month of April, 1967 the City Planning $oard
recommended the removal of billboards in its publication: "St. Paul's Free-
ways, An Opportunity in Civic Design."
The major shortcoming of the proposed ordinance is its attempt to establish
different "control segments", prohibiting billboards in some segments and
allowing them in others. This approach has built-in problems:
l. Year after year the powerful billboard lobby would "nibble"
away at the definition of these segments. We would have to
be constantly on guard against such changes.
2. The harmful affects of distracting billboards on safety are
equally great to the motorist in every segment. Several studies
have demonstrated a much higher accident rate on roadways with
billboards. This is especially true on high speed roads with
frequent interchanges in urban areas. We should not ban safety
hazards in one segment therefore, only to allow them in others.
3. Not all commercial and industrial segments are ugly, and the
appearance of all would be improved by banning billboards in
all segments.
�+. We are talking about roadways which are new and in very few segments
are we talkin� about tearing down long-established billboards.
5. Wisconsin to the east and Minneapolis to the west are banning
billboards on their freeways. We cannot afford to be an eyesore
between them. (Unfortunately, under lobb�ist pressure, the total
prohibition in Minneapol�s only covers 330 feet to each side of
the right-or-way. In St. Paul the prohibition should extend
660 feet as it does in other progressive cities. )
Obviously, the position we urge you to take is to amend the proposed
ordinance, so as to prohibit billboards in all segments within 660 feet of
I-9�+, I-35, T.H. 280, Warner Road, Shepard Road and the Shortline Express-
way. Secondly, we recommend you support an exemption for on- premise
business identification signs up to 200 square feet. Finally, to be
completely fair in fact, generous , we solicit your support of a provision
which would allow up to five years for the removal of non-conforming signs.
The Merriam Park Community Council, like most other citizens without an axe
to grind, believes the huge investment by the public in these freeways must
be protected from violation by the few selfish interests who stand to gain
by inadequate controls.
We look forward to your full support at the hearing on February 20.

The city of St. Paul should follow the example of
San Francisco and keep billboards off the freeway,
according to Msgr. Francis J. Gilligan, pastor of St.
Mark's parish, St. PauL
Referring to the Merriam Park com-
munity council's resolution sent to the

Gilligan in the Jan. 28 St. Mark's par-
ish bulletin noted that the one primary
reason for the freeways is safety.
"The speed is rapid," he said, and
' "it is difficult to read the official di-
� rectional signs. The presence of bill-
boards would complicate the effect.
"Furthermore, the federal govern-
ment is spending miltions to beautify

I write to you� n�r elected representative, to express my support for
pas�age of a stxong billboard control ordina.nce by theCity Counci7.. I
feel the proposed ordinance presently before you could and should be
improved by restricting all signs within 660 feet of the r ight-of-way
along Warner Road� Shepard Road, the Short Line Expressway and the
Interstate highways, rather than allowing billboards in certain areas.
Several studies have demonstrated a much higher accident rate on road-
ways with billboards. The danger of distraction and sign-confusion on
heavily-traveled� higl�speed highways.through the city is especially
great, and it is present in all areas of the roadway.
Nillions of dollars are being spent on the freeway system; this publ�c
investment should be protected, Lben as I appreciate thsir convenience
tremendously, I am also appreciative of their eye-pleasing featvres
and proud of St. Paul for the pleasing image they convey. I would like
to look forward to years of such appreciation and pride in my city.
A chief argument of the billboard lobby, I understand� is that such
restricting ordinances ta.ke away their rights and freedom. But nothing

2 and 3, shown on the official map which accompanies this crdin-
ance and is hereby declared to be part hereof."

paragraph:
"No advertising device which is visible from any part of the
traveled roadway may be erected or maintained within 330 feet
of the right-of-way of an advanced speed artery running through
Advertising Device Control Segment 3."

segments adjoining I-9�+ and I-35 which are not designated as Advertising
Device Control Segment 1 are to be designated as Control Segment 3.

Section 1 - amend subsection 7 to read as follows:
(7) NONCONFORMING USES. All advertising devices which do not
conform to the requirements of this section regarding size,
spacing, or illur.�ination shall be brought into conformance
upon the adoption of this ordinance. Any advertising device
which is in violation of this section solely because it is
located within Control Segments 1 and 3 as of the date this
ordinance becomes effective shall be regarded as nonconforming
and may be continued except that, within five years of the
effective date all such advertising devices shall be removed
or relocated so as to eliminate any conflict with this section.
Section 1 - strike subsection (6) and insert in lieu thereof the following:
(6) LIGHTING AND MOVEMENT. No advertising device shall display
any moving parts, nor shall it be illuminated with any flashing
nor intermittent lights. Al1 devices shall be shielded to prevent ar�y
light to be directed at oncoming traffic in such brilliance as to
; impair the vision of any driver. No device shall be illuminated in
such a fashion as to interfere with or obscure an official traffic
sign or signal. No device shall be illuminated in such a fashion
that causes light to be directed toward a residential area.

At the request of the Mayor, Mr. Summers, Corporation COLlriS@�� explained the ordinance
as originally proposed and the a�endments as proposed today.
Comsr. Dalglish said the m�tter of contro� of bi.11boards came �o his attentior� about
18 months a�o and he referred to many meetings si�cp then and he referred to his
request to the Buildi.ng Bureau to hold any building permits which has been complied
with. He urged some contrbl and said the ordinance should be adopted.
Mayor Byrne said that because of previous public hearings and because ma.ny groups
have expressed thei.r feelings to Councilmen, he would suggest that individuals
appearing be brief �n� do not repeat others' remarks an� he suggested one-half

urging complete �prohibition of billboards along freeways in the City. He referred
to a meeting attended by many church groups and community groups who voted unanimously
for complete prohibition. He referred to an agreement between St. Paul and Minneapoli.
