to the plat on file and of record in the
office of the Register of Deeds in and
for the County of Ramsey, State of
Minnesota.

WHEREAS, Pursuant to resolution, C. F. 236087, approved ,
Deeember 12, 1967, a public hearing was duly held on Tuesday,
Deeember 26, 1967, beYore the Council of the City of Saint Paul,
said hearing pertaining to the condition of the structure located
at 412 North Smith Avenue, Saint Paul, Minnesota; and
WHEREAS, Upon the facts presented at the said hearing
consisting o� photographs, inspection reports and the recommenda—
tion of the City Architect, it is found and determined by the
City Council that according to the reeords and files in the
office of the Register of Deeds, the last record owner of the
above—deseribed property is 'Molly Alpert; that Joseph J. and Mary
Kohout are the mortgagees; and that there are no other lien
holders of record; that the taxes for 1965 and 1g66 are unpaid;
and that it is � further determined that the above-described building
constitutes a hazardous building within the definition of Minnesota
Statutes Section 463.15 for the following reasons:
a. The building has been extensively
damaged by fire, is standing vacant, and is
subject to entry by unauthorized persons;

b. The chimney is deteriorated, the rear
stairway and porch is in danger of collapse,
the exterior brick veneer is cracked with some
bricks in danger of falling, and the roof has
open holes;
c. The interior of the building is
littered with debris , including food products ,
and constitutes a rodent harborage;
d. The interior of the building has been
vandalized, the first floor wood posts are
deteriorated, plumbing fixtures are broken and�or
removed, and the electrical and heating systems
are out of working condition;
e. The building is unfit for human habita-
tion in its present condition and must be
corrected so as to comply with the Saint Paul
Building Code and the Saint Paul Hou�ing Code
in order to make the same habitable;
f. The building in the above condition
appears to be beyond reasonable repair;
g. The building constitutes a nuisance
and a hazard to the public health, safety
and welfare because of its physical damage,
dilapidation, abandonment and inadequate main-
tenance;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes
Sections 463. 15 through 463. 26, and based upon the foregoing
findings of the City Council , the Council of the City of Saint
Paul does hereby make the following Order:

ORDER
l. That the owner of the above-described building shall
make the same safe and not detrimental to the public health,
safety and welfare by having the said building razed and the
materials therefrom removed from the premises within thirty (30)
days from the date of the service of this Order or, in the
alternative, begin to correct the hazardous conditions within
thirty (30) days from the date of the service of this Order to
correct the hazardous conditions by doing the following:
a. Remove all paper and other combustible
materials from the building and securely close
and keep closed all doors, windows or other
openings in the building;
b. If the building is to be used for human
habitation, all of the above defective conditions
must be corrected and the building corrected so
as to comply with and meet the Saint Paul Housing
Code and the Saint Paul Building Code requirements ,
and that the owner submit a list of intended
corrections regarding the structural condition
of the building, electrical and heating system,
together with a schedule for the completion of
the rehabilitation program and that the owner
apply for the necessary permits in the office of
the City Architeet within the thirty (30) days
imposed herein.
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of the District Court of Ramsey
County, Minnesota, within twenty (20) days from the date of the
service of this Order, a Motion for Summary Enforcement of this
Order to raze and remove the said building will be made to the
Ramsey County District Court.

3. In the event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Gourt,
all person.al property or fixtures which may unreasonabl� in.ter-.
fere with the razin and removal of this building shall be
removed within ten �10) days from the entry of judgment; and
if not so removed, the City of Saint Paul shall remove .and
dispose of such personal property and fixtures as provided by
law.
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City of Saint Paul will be assessed against the above-described
real esta�e and collected as other taxes; and be it _
� FURTHER RESOLVED, That a certified copy of this resolution
and incorporated Order herein be served upon the last record
owner of the above-described property in the manner provided by
law and also upon other interested parties in the manner provided
by law.

Gentlemen:
The Building Department is hereby submitting its report on the condition
of the property known as 412 N. Smith, a store and apartment occupancy.
The owner of record is Molly Alpert under the guardianship of Libby Siegel.
The legal description of the property is South 40 feet of North 90 feet
of Lots 8 and 9, Block 5, Leech's Addition to St. Paul.
A recent inspection indicates that the property at 412 N. Smith is classified
as a store and apartment occupancy. The building is of frame construction
with a brick veneer exterior, two stories in height and contains a full basement.
The building is approximately 39 feet wide, 90 feet long and 30 feet in height.
At the present time, the building is vacant and only partially secure. It was
extensively dama.ged by fire some time ago and no attempt has been ma.de to repair
it.
EXTERIOR
On the exterior of the building the chimney is in poor condition with the mortar
joints eroding and some of the bricks already missing. The rear stairway and
porch construction has been badly dama.ged by fire and is in danger of collapse.
The brick veneer is cracking in some areas. Some bricks have already fallen
out with other areas along the parapet badly eroded. The rear porch section,
which was of a frame construction had imitation brick siding. Much of this
has been removed and other areas have deteriorated and have been torn off. The
roofing on the rear section has ma.ny open holes and the entire roofing is very
loose.
BASEMENT
The basement is littered with much debris, including some food products. The
first floor wood joists have been given temporary support along the north wall
due to deterioration of the wood joists. There is no ventilation to the basement
and a toilet serving the first floor is located there, which is in violation
of the St. Paul code requirements. The plumbing fixtures are also broken and
not in condition to be used.

FIRST FLOOR
The first floor, which was the store occupancy, has been extensively vandalized.
The pluuibing fixtures have been removed and several of the rooms at the rear
and the garage are badly damaged by fire. The entire area is littered with all
kinds of debris, including food products.
SECOND FLOOR
The second floor of the building, which contained two three-room apartments,
has all the windows broken. The rear apartment has been completely gutted
by fire, the plumbing fixtures have all been removed and the entire area is
littered with burnt furniture, clothing and other materials.
The electrical system has been disconnected and is out of service. The heating
system, which was by a steam hot water system and some stove heating units in
the rear addition, is completely out of service.
If it is the opinion of the owners of this property that it can be rehabilitated,
it will be necessary that they submit the list of corrections which they propose
regarding the structural condition of the building, as well as the electrical,
plumbing and heating systems, with a schedule for the completion of the
rehabilitation program, along with the application for permits.
If the foregoing schedule is not submitted by the owner, it is the conclusion
of the Bureau of Public Buildings that by reason of inadequate maintenance,
dilapidation, physical dama.ge, unsanitary condition and abandonment, the above
structure constitutes a hazard to public health, safety and welfare. It is
further recommended by the City Architect that the Council concur in this
conclusion and refer the matter to the City Attorney's office for submission
of this condemnation to the District Court.
