04-430RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By Referred to Council File # O •� � � Green Sheet # 01 ��� V ZS Committee: Date 1 WHEREAS, the City of St. Paul is hosting the Star of the North and is planning a diving event on June 19, 2 2004 at the Bush Student center Pool ; and 3 WHEREAS, Hamiline University has jurisdiction over the Bush Student Center Pool, and has granted 4 permission for the use for such an event with the stipulaUon that the City of St. Paul hold harmless the 5 University:; and 7 WHEREAS, the Saint Paul City Council finds that the Star of the North State Games' diving event has a 8 legitimate public purpose; and 9 WHEREAS, the expenditure of public funds, which includes the promise of indemnificarion and defense, for 10 such a purpose will facilitate and enable the event to take place; now, therefore, be it 11 FURTHER RESOLVED, that the foregoing defense and indemnificahon does not cover: 12 1.) any occurrences or events which are not part of the Star of the North State Games diving event and 13 which do not occur or or take place at the Bush Student Center Pool during the course of the event. 14 2) injuries or daxnages which arise from hidden traps or conditions existing on the grounds 15 surrounding the Bush Student Center Pool of which Ha�iline University had actual construcrive norice. 16 3) injuries which arise out of criminal actions, assaults, batteries, or other acts of violence committed 17 by any person or persons; and be it 18 FURTHER RESOLVED, that nothmg in the foregoing provisions shall be construed as a waiver of the 19 municipal tort liabiliry limits set forth m Minn SYat.
