PAUL FIOENCIL NO. _ � OFFICE OF THE CITY CLERK � COUN RESOLU ON-GENERAL FORM PRESENTED BY � COM M I SSI ON E � OATE _ In the Matter of a hazardous building being that two story dwelling known. and described as 854 Selby Avenue, also known as 16�-170 Victoria, i-n the City of Saint Paul and situated upon those premises legally described as Lot 9, Block 9, Nininger & Donnelly' s Addition to Holcombe' s Addition to Saint Paul, according to the plat on file and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Minnesota. WHEREAS, Pursuant to resolution, C. F. 235241, approved October 3, 1967, public hearings were duly held on October 17, 1967, November 30, 1967, and December 28, 1967, b�fore the Council of the City of Saint Paul, said hearings pertaining to the con— dition of the structure located at 854 Selby Avenue, also known. • as 162-170 Victoria, Saint Paul, Minnesota; and Wf�REAS, Upon the facts presented at the said hearings consisting of photographs, inspection reports and the recommenda— tion of the City Architect, it is found and determined by the City Council that according to the records and files in the of�ice of the ftegister of Deeds, the last record own.er of the above—described "^ property is Eichinger Properties; and that there are no other lien � holders of record; and that it is further determined that the . above—described building constitutes a hazardous building within � .�,o the definition of Min.nesota Statutes Section 463.15 for the o � following reasons: �` � . • a. The building is standing vacant, sub— � c7 ject to entry by unauthorized persons and has been subjected to extensive vandalism; . ;� b. The condition of the interior of the` _ building is as follows: cornice boards are COUNCILMEN Adopted by the Council 19_ Yeas Nays Carlson � Dalglish Approved 19.^ Holland Tn Favor Meredith Peterson Mayor Tedesco A gainst Mr. President, Byrne �22 . 23s�`2 Page 2. beginning to rot, windows and frames are broken and falling apart , concrete floors are deter- iorating, foundation mortar joints are eroded, there is an open sewer connection, stair treads are broken and dilapidated, the wall covering material is smashed, window frames , sills and floors are rotting and sag, toilet rooms are not ventilated, and the interior of the building is littered with combustible material; c. The back porch is pulling away from the wall , brick on the outside walls are deteriorated with mortar missing, the catwalk is in need of repair and the parapet wall at the rear is in danger of falling; d. The building is unfit for human habitation in its present condition and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; e. The building appears to be beyond reasonable repair; f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapida- tion and inadequate maintenance; �I now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based on the foregoing findings of the City Council , the Council of the City of Saint Paul does hereby make the following Order: ORDER l. The owner of the above-described building shall make the same safe and not detrimental to the public health, safety and welfare by having the said building razed and the materials � - � 23�552 Page 3. therefrom removed from the premises within thirty (30) days from the date of the service of this Order or, in the alterna- tive, begin to correct the hazardous conditions within thirty (30) days from the date of the service of this Order to correct the hazardous conditions by doing the following: a. Remove all paper and other combustible materials from the building and securely close and keep closed all doors, windows or other openings in the building; b. If the building is to be used for human habitation, all of the above defective conditions must be corrected and the building corrected so as to comply with and meet the Saint Paul Housing Code and the Saint Paul Building Code requirements, and that the owner submit a list of intended corrections regarding the structural condition of the building, electrical and heating system, together with a schedule for the completion o� the rehabilitation program and that the owner apply for the necessary permits in the office of the City Architect within the thirty (30) days imposed herein. 2. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this I Order to raze and remove the said building will be made to the Ramsey County District Court. 3. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with the razing and removal o� this building shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law. , � ORI6INAL TO GITY CLERK ������) �, - CITY OF ST. If the City of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above—described real estate and collected as other taxes; and be it FURTHER RESOLVED, That a certified copy of this resolution and incorporated Order herein be served upon the last record owner of the above—described property in the manner provided by law and also upon other interested parties in the man.ner provided by law.
