WF�REAS, The 5tate of Minneeota, Department of Highways, in the matter of the
condemnation of certain lands for trunk highway purpo�es, Ramsey County District
Caurt No. 339511-512, has condemnsd a part of the easem�ents acquired by the Board
of �ter Com�nissioners along County Road �'I" and Highway 35�13 and
WHEREAS� The Report of the Comcaissioners appointed by the Ramsey District Court
made an axard of "no damages" to the Board. of Water Conmaissioners for the taking;
and,
WHEREAS, The Board through the Corporation Counsel appealed to the District Court
on t.he grounde that the failure to award. damages by Cor►miissioners to the Board�
as set forth in their report, was grossly unfair; and�
WHE�"REAS� The Sta.te is �rilling to negotiate and pay the :Board the sum of $2500.00
and install appro.ximately 2l�0 feet of 78" Casing Pipe (to be .furnishsd by the
Board) as settle�nt of the Board�s appeals an.d all claims of damages as to
Parcel 3�A and Parcel 8,
NUW� THEREFORE, BE IT RESOLVED� By the Board of Water Cormnissioners, that for
the purpose aforesaid the proper o�'ficers of the Board sha.11 be and they are
hereby authoriaed and directed to properly execute the annexed Stipulation for
Settlement of Appeal as to Parcel 3A an�d Parcel 8� (S.P. 628l�(39l�)902).
