1 WHEREAS, El Burrito Market, Inc. d/b/a El Burrito Mercado, located at 175 Concord in
2 Saint Paul, has requested a waiver of the 45-day notice requirement for issuance of on-sale strong
3 Malt and On Sale Wine licenses; and

WHEREAS, the West Side Citizen's Organization/District 3 Community Council has

agreed to the waiver of the notice requirements; and
WHEREAS, the Council finds that the application is in order and there aze no grounds for
denial of the license and that failure to grant the waiver and the consequent delay in approving
the license would cause exceptional and unusual hazdship to the license applicant; and
WHEREAS, the licensee agrees that in the event a complaint is received prior to the
expiration of the 45-day period and the complaint provides a basis for adverse action against the
license, that the Office of License, Inspections and Environmental Protection may direct the
licensee to immediately discontinue aIl operations unTZl a public hearing is scheduled, and that
the licensee shall comply with said directive; now, therefore, be it
RESOLVED, that the 45 day notice requirements of §409.06 of the Saint Paul I.egislative
Code aze hereby waived and on-sale strong Malt and On Sale Wine licenses licenses aze issued
to El Burrito Market, Inc. d/b/a El Burrito Mercado, located at 175 Concord in ,
Saint Paul, subject to the agreement stated above.

Bunito Mercado located at 175 Concord St. in their request for a Wine and Beer License.
As a commmmity development corporation in District del Soi on Saint Paul's West Side,
we recognize the many benefits of El Burrito Mercado's recent expansion and
rernodeling project and believe that offering beer and wine will complement their ne�v
