I transmit herewith preliminary estimate of cost for the construction of a relief
sewer whose centerline Is described as follows: beginning at a point located at
a bearing of N 890 32' W and a distance of 214 feet from the NW corner of the HE
1/4, of the SE 1/4 of Section 300 T 29 N - R 22 W; thence at a bearing of S 200
06' E a distance of 335.76 feet; thence at a bearing of S 270 06' E a distance of
300 feet; thence at a bearing of S 450 26' E a distance of 450.00 feet; thence at
a bearing of N 550 19' E a distance of 250 feet more or less to the existing
Troutbrook Sewer, and all to be known as the TROUTBROOK -CASE AVE. SEWER, S- 1274A,
under Preliminary Order C. F. No. 241236, approved December 6, 1968.
For the Intermediary Order, the description for the sewer should be changed to
the following: construct a relief sewer In an easement with the centerline of
said easement being described as follows: beginning at a point located at a
bearing of N 890 32' W and a distance of 214 feet from the HW corner of the
HE 1/4, of the SE 1/4 of Section 30, T 29 N - R 22 W; E':ence at a bearing of
S 200 06' E a distance of 335.76 feet; thence at a bearing of S 270 06' E a
distance of 300 feet; thence at a bearing of S 450 26' E a distance of 450.00
feet; thence at a bearing of N 550 19' E a distance of 250 feet more or less to
the existing Troutbrook Sewer.
The aforementioned easement had Its Preliminary Order approved December 6, 1968,
under C. F. No. 241237. It is being drawn up and recorded by the Office
Engineer, Hr. Hyman J. Goldberg, and as soon as this Is done, he will report to
the Commissioner of Finance.

NOTICE OF PROTEST
TO THE CITY COUNCIL OF THE CITY OF ST. PAUL, MINNESOTA:
You ande:ach,of you are hereby notified that the Soo Line Railroad
Company, being aggrieved, does hereby protest the action of the City
Council and does file this Notice of Protest with the City Clerk of said
City, and the grounds upon which this protest is based are as follows:
I.
That it is an owner of property within the City of St. Paul,
Minnesota.
II.
That a portion of its property is located within the relief sewer
improvement district and is being assessed therefor.
III.
That the Soo Line Railroad's present and future use of said property
is restricted entirely to railroad uses and will not benefit from the
sewer improvement.
IV.
That, as to the Soo Line Railroad Company property, any assessment
would be arbitrary, capricious, unjust, discriminatory, inequitable and
excessive.
LTA
That any assessment against the Soo Line Railroad Company's property
would result in depriving the protestant of said property without due process
of law in violation of Section I of the 14th Amendment to the United States
Constitution and in violation of the Constitution of the State of Minnesota.
