PAUL COUNCIL NO �' ` ` ' OFFICE OF THE CITY CLERK FILE C NCIL RESOL TION-GENERAL FORM PRESENTED BY COMMISSIONE � ATF WI�REAS, under the provisions of the Minnesota Municipal Housing :fa.nd Redevelopment Act, the Housing and Redevelopment Act, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (herein called the "Authority" ) is authorized to undertake urban renewal redevelopment projects in blighted, deteriorating and deteriorated areas within the Gity of` Saint Paul , Minnesota; and WHEREAS, it is provided in such Act that after the Authority has determined that a project be undertaken, the Authority shall not proceed therewith until the governing body of the municipality shall, after receiving the report of the planning agency upon the plan for said project, in the submission to said governing body of the Redevelopment Plan, financial plan, and relocation plan� and after a public hearing upon the same shall find that: (1) The land in the project area would not be made avail- able for redevelopment without the financial aid to be sought; (2) The Redevelopment Plan for the urban renewal area will afford maximum opportunity, consistent with the sound n.eeds of the locality as a whole, for the redevelopment of suck� area by private enterprise ; and -� (3) The Redevelopment Plan conforms to the general plan �' 1� for the development of the locality as a whole ; and ;.► �) o q WHEREAS, it is provided in such Act that the cost of a �, .� redevelopment project may be financed by those mean.s set forth w � in Minnesota Statutes � Section 462.545, including grants or other � financial assistance from the Federal government with the pro- � m viso that before other methods of financing authorized by said Section are resorted to, the Authority shall make full utiliza- tion of all such Federal funds for which the project qualifies ; and COUNCILMEN Adopted by the Council 19— Yeas Nays Carlson Dalglish Approved 19—_ Meredith _jn Favor Peterson ' Sprafka Mayor Tedesco A Sainst Mr. President, Byrne O • t . . . �r�'���� 4 Page 2. WI�REAS, under the provisions of Title I of the National Housing Act of 1949, as amended, the Secretary of the Department of Housing and Urban Development is authorized to provide finan- cial assistance to Local Public Agencies , such as the Authority , for the undertaking of Early Land Acquisition Activity under Section 102(a) of said Title I and for the undertaking of urban renewal projects under Section 103 and Section 131 of said Title I ; and WHEREAS, it is provided in said Hot�sing Act that contracts for financial aid under said Sections 103 and 131 of Title I shall require that the Redeve lopment Plan for the urban renewal redevelopment area be approved by the governing body of the locality in which the project is situated, and that such approval shall include �indings by the governing body that ; (1) The financial aid to be provided in the contract is necessary to enable the project to be undertaken in accordance with the Redevelopment Plan; (2 ) The Redevelopment Plan will afford maximum opportunity, consistent with the sound needs of the locality as a whole , for the rehabilitation or redevelopment of the urban renewal area by private enterprise ; (3) The Redevelopment Plan conforms to a general plan for the development of the locality as a whole ; (4) The Redevelopment Plan gives due consideration for the provision of adequate park and recreational areas and facilities as may be desirable for neighborhood improvement , with special consideration for the health, safety, and welfare of the children residing in the general vicinity of the site covered by the Plan; and WHEREAS, the Authority has made application for and entered into a planning contract for financial assistance under said Housing Act of 1949, as amended, with the United States of �merica, pursuant to which Federal funds were provided for the survey and planning of the Auditorium Urban Renewal Area, and the Authority has presented to Council for its consideration and approval an Application to Undertake Project Activities During the Project Planning Stage to be financed by a Federal loan under Section 102(a) , Title I of said National Housing Act, and the Authority will make further appl 'r.ation to the United States of America for a Loan and Capital Grant Contract under Section 103 or � Section 131 of said Title I, and proposes to enter into additional contract or contracts for said Loan and Grant for the undertaking of and making available additional financial assistance for the Auditorium Urban Renewal Area Project, Minn. R-53, in accordance with the aforesaid Application; and � . . �4�;t��� Page 3. WHEREAS, the Authority has made detailed studies of the location, physical condition of structures , land use , environ- mental influences , and social , cultural , and economic conditions of the Auditorium Urban Renewal Area, and has determined that the area is a blighted, deteriorated and deteriorating area detrimental to the safety, health, welfare , and morals of the inhabitants and users thereof and of the locality at large becaus e of : (1) The existence of substandard and obsolescent buildings ; (2) The existence of incompatible and deleterious land uses andthe overcrowding of buildings on land of the project area; (3 ) The existence of excessive dwelling unit density in structures devoted in part to residential use ; and (4) The existence of an inadequate st�eet �ayout and cir- culation system within the project area; and further determined that the elimination of such conditions of deterioration and blight could only be accomplished by govern- mental assistance necessitating the application for a Federal Ioan pursuant to the provisions of Section 102(a) Title I of the Housing Act of 1g49, as amended, in the amount of Three Million Two Hundred Thirty-six Thousand Two Hundred Thirty-two Dollars (�3,236, 232. 00) as necessary to enable the Authority to acquire and demolish substandard and blighted properties , to relocate site occupants , to assembl� and dispose of lands for purposes of redevelopment and to make provision for necessary public improvements ; and WHEREAS, there has been prepared and referred to Council for review and approval a Redevelopment Plan for the Project Area described as "Rede�opment Plan Auditorium Renewal Project Minn. R-53" , dated September g, 1g68, consisting of twelve (12) pages and two (2) maps , supported by the following supplementary material , data, and recommendations , which material , data, and recommendations in addition to the documentation heretofore on file , are not a part of the Redevelopment Plan : (1) Application for Early Land Acquisition Loan, Auditorium Minn. R-53, being an application to undertake project activities during project planning stage , containing as contents - (a) Section E-201, Application for Loan and Grant; (b) Section E-202, Labor Standards ; . . � �4�;UU� Page 4. (c ) Section E-212, Project Area Report ; (d) Section E-214, Basis for Determination That Objectives of Plan cannot be Achieved through Rehabilitation; (e) Section E-222, Land Acquisition Report; (f) Section E-223, Relocation Report; (g) Section E-224, Basis for Estimates of Clearance Costs ; (h) Section E-226, Cost Estimates and Financing Report; and (i) Section E-231, Legal Data; and (2) Extract of minutes of the meeting of the Planning Board of Saint Paul held on Monday, September 16 , 1968, adopting a report of said Planning Board respecting the Redevelopment Plan, Auditorium Renewal Project, Minn. R-53; and WHEREAS, the Redevelopment Plan has been approved by the Commissioners of the Authority, as evidenced by the copy of the Authority' s duly certified resolution approving said Redevelopment Plan,_ on file with the City Clerk; and WHEREAS, the City Planning Board of the City of Saint Paul , which is the duly designated and acting official planning body for the City, has submitted to the Council its report and recom- m�ndations respecting the Redevelopment Plan for the project area, and the Council has duly considered the same ; and WHEREAS, the Redevelopment Plan for the project area pre- scribes certain land uses for the project area and will require , among other things , the vacation and removal of certain streets , construction or reconstruction of other streets , utilities , and certain other public actions in connection with the Civic Center Project ; and WHEREAS, theAuthority has prepared and submitted a Relocation Report containing a program and plan for the relo�a- tion of individuals and families and businesses that may��"is- placed as a result o� the carrying out of the project in accord- ance with the Redevelopment Plan; and WHEREAS, there has also been presented to the Council information and data respecting the relocation program which has been prepared by the Authority as a result of studies, surveys , and inspections in the project area, and the assembling and analysis of the data and information obtained from such studies , surveys , and inspections ; and Page 5 • ��'��+�!`� WHEREAS, the members of the Council have general knowledge of the conditions prevailing in the pro�ect area, and of the availability of proper housing for individuals and families and locations for businesses for the relocation of said individuals , families and businesses that may be displaced in the project area, and , in light of such knowledge, have carefully considered and reviewed the Authority' s proposals for relocation; and WI�REAS, it is necessary that the Council take appropriate official action respecting the relocation program, the Redevelop- ment Plan, and the financial plan for the project in conformity with the provisions of the Municipal Housing and Redevelopment Act ; and WHEREAS , the Council is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal redevelopment projects with Federal financial assistance under Title I, including those prohibiting discrimination because of race , color, creed, or national origin; and WHEREAS , there has been presented to and considered at this meeting a document entitled, "Cooperation Agreement Respecting Auditorium Renewal Project Minn. R-53" , between the Authority and the City, a copy of which is hereto attached, reciting the respective undertakings of the parties to undertake the project, including their respective obligations respecting land acquisition, vacation of streets , relocation of utilities , and sale and purchase of project lands for re- development of the Civic Center Complex under the provisions of Chapter 459, Laws i967, and to finance said project ; Now, Therefore , be it RESOLVED, by the Council of the City of Saint Paul , upon public hearing pursuant to said Council ' s prior resolution, Council File No . 241657 , approved January 10, ig6g, and upon the consideration of the application of the Housing and Redevelopment Authority of the City of Saint Paul,Minnesota, for said Council ' s approval o� the Redevelopment Plan for Auditorium Renewal Area, Project Minn. R-53, the area which project boundaries thereof are described and published in said Resolution, Council File No . 241657 and i�.corporated herein by reference : � (1) That it is hereby found and determined that the project area is a blighted area, which conditions of blight are detrimental to the public health, safety , welfare , and morals ; that the proposed project qualifies as an eligible urban renewal redevelopment project under the Minnesota Municipal Housing and Redevelopment Act , • � - , , �������� Page 6. (2) That the Redevelopment Plan for the Project, having been duly received and considered, is hereby approved, and the Clerk be and is hereby directed to file said copy of the Redevelopment Plan with the minutes of this meeting . (3) That it is hereby found and determined that the objectives of the Redevelopment Plan cannot be achieved th rough rehabilitation in the Project Area. (4) That it is hereby found and determined that the Re- development Plan for the Project Area conforms to the objectives of the comprehensive plan for Saint Paul . (5) That it is hereby �ound and determined that the finan- cial aid to be provided pursuant to contracts for Federal �inan- cial assistance , and the financial assistance of the City of Saint Paul and other State public bodies , is necessary to en- able the Project tobe undertaken and for the land in the Project Area to be made available for uses in accordance with the Redevelopment Plan for the Project Area . (6) That it is hereby found and determined that the Redevelopment Plan for the Project Area providing for disposition of project lands to the City of Saint Paul for redevelopment as a Civic Center Complex, with altern ative use privately developed residential housing, will afford maximum opportunity, consistent with the sound needs of the locality as a whole , including the construction and reconstruction of the Auditorium Complex, is authorized by Chapter 459 , Laws 1g6'7 , for the redevelopment of the area by private enterprise . (7 ) That it is hereby found and determined that the Redevelopment Plan for the Urban Renewal Area gives due con- sideration to the provision of adequate park and recreational areas and facilities as may be desirable for neighborhood im- provement , with special consideration to the health, safety, and welfare of the children residing in the general vicinity of the site covered by the Plan, in that the reconstruction and construction of an Auditorium Complex - Civic Center in this predominantly non-residential area will provide recreational and cultural facilities upon a City-wide basis to all inhabitants of said City. (8) It is hereby found and determined that the program for proper relocation of individuals displaced in carrying out the Project in decent , safe , and sanitary dwelling units in conformity with acceptable standards is feasible and can be reasonably and timely effected to permit the proper prosecu- tion and completion of the Project ; that such dwelling units available or to be made available for such displaced individuals . _ . . . Page 7 . ����V`� are at least equal in number to the number of displaced indi- viduals and families and are not generally less desirable in regard to public utilities and public-commercial facilities than the dwelling units of the displaced individuals in the Project Area, are available at rents and prices within the financial means of the displaced individuals and families , and are reasonably accessible to their places of employment . (9) That in order to implement and facilitate the effec- tuation of the Redevelopment Plan hereby approved, it is found and determined that certain official actions must be taken by this body with reference , among other things , to changes in zoning , vacating and removal of streets , alleys , and other public ways , the establishment of new street patterns , and the location and relocation of public utilities and other public action, and, accordingly, this body hereby: (a) Pledges its cooperation in helping to carry out the Redevelopment Plan; (b) Requests the various officials , departments , boards and agencies of the locality having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions an d powers in a manner c�nsistent with the Redevelopment Plan; and (c) Stands ready to consider and take appropriate action upon the proposals and measures designed to effectuate the Redevelopment Plan, including the provision of local share of the financial assistance therefor. That , in order to assure the effectuation of the Plan provisions for financing of the pro- ject undertaking , with or without federal money grant assistance , which commitments and undertakings are spelled out in a Coopera- tion Agreement Respecting Auditorium Renewal Project, Minn. R-53, by and between the Authority and the City , a copy of which Agreement has been presented to and considered at this meeting, the Council hereby approves said Cooperation Agree- ment and authorizes the proper officers of the City to execute the same on behalf of the City; that the Clerk is hereby directed to file a copy of the said Cooperation Agreement, as executed, with the minutes of this meeting and with the Office of the Comptroller . (6) That it is hereby found and determined that the Redevelopment Plan for the Project Area providing for disposition of project lands to the City of Saint Paul for �edevelopment as a Civic Center Coruplex, with altern ative use privately developed � residential housing, will afford maximum opportunity, consistent with the sound needs of the locality as a whole , including the construction and reconstruction of the Auditorium Complex, is authorized by Chapter 459 , Laws 1g67 , for the redevelopment of the area by private enterprise . - (7) That it is hereby found and determined that the Redevelopment Plan for the Urban Renewal Area gives due con- sideration to the provision o.f adequate park and recreational areas and facilities as may- be desirable for neighborhood im- provement , with special consideration to the health, safety, and welfare of the children residing in the general vicinity of the site covered by the Plan, in that the reconstruction and construction of an Auditorium Complex - Civic Center in this predominantly non-residential area will provide recreational and cultural facilities upon a City-wide basis to all inhabitants of said City. (8) It is hereby found and determ�ined that the program for proper relocation of individuals displaced in carrying out . � the Project in decent, safe , and sanitary dwelling units in conformity with acceptable standards i� feasible and can be reasonably and timely effected to permit the proper prosecu- tion and completion of the Project; that such dwelling units available or to be made available for such displaced individuals . � Page '7 . _ 24'�VU`t . are at least equal in number to the number of displaced indi- . viduals and families and are not ge�erally less desirable in regard to public utilil;ies and puulic-commercial facilities than the dwelli.ng units of 1;he displa.ced individuals in the Project Area, are available at rents and prices within the financial means of the displaced individuals and families , and are reasonably accessible to their places of emplo�ment . (9) That in order to implement and facilitate the effec- tua�ion of the Redevelopment Plan hereby approved, it is found and determined that certain official actions must be taken by . � this body with reference , among other things , to changes in �zoning , vacating and removal of streets , alleys , and other public ways , the establishment of new street patterns , and the location and relocai�ion of public ui;ilities and other public aetion, and, accordingly, this body hereby: � (a) Pleclges its cooperation in helping to carry out the Redevelopment Plan; � " (b) Requests the various officials , departments , boards and agencies of the locality having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner c�nsistent with the Redevelopment Plan; and � (c) Stands ready to consider and take appropriate action • upon the proposals and measures designed to effectuate the Redevelopment Plan, including the provision of local share of the financial assistance therefor. That , in order to assure the effectuation of the Plan provisions for financing of the pro- ject undertaking, with or without federal money grant assistance , which commitments and undertakings are spelled out in a Coopera- tion Agreement Respecting Auditorium Renewal Project, Minn. R-53, by and between the Authnrity and the City , a copy of which Agreement has been presented to and considered at this meeting, the Council hereby approves said Cooperation Agree- ment and authorizes the proper officers of the City to execute the same on behalf of the City; that the Clerk is hereby directed to file a copy of the said Cooperation Agreement, as executed, with the minutes of this meeting and with the Office of the Comptroller.
