Byrne, Mayor � and Members of the City Council Gentlemen: On February 18, 1969 a letter addressed to the City Council signed by John F. Bureau requesting a refund of the filing fee paid in connection with an application for a .special use permit for an Arby' s Drive-In Restaurant at Snelling and Carroll Avenues was referred to me for consideration and reply. Section 64.06 of the Zoning Code states that if a petition for an amendment, supplement, change or repeal of the regulations prescribed for a district or part thereof is referred by the Council to the Board of Zoning and then withdrawn at the request of the petitioner prior to the time the Board of Zoning files a report with the City Council, the Council may at the request of the petitioner, grant a refund of the filing fee not to exceed 50/ of that filing fee. In this instance, Mr. Bureau withdrew his application for a special use permit before the Zoning Board referred the matter to the City Council and, in my opinion, is entitled �o a 50% refund of . the filing fee paid in accordance with the ordinance quoted above. truly our , � obert L. Bureau, for a Special Use Permit for an Arby's Drive-In Restaurant at the intersections of Snelling and Carroll Avenues. This application was withdrawn when the applicant noted the objections of the neighboring residents. The applicant submitted another application at a later date for approval of a Red Barn Restaurant which was approved by the City Council on January 14, 1969.
