Daubney, Attorney at Law for the refund of a filing fee paid for an application for amendment to the Zoning Code for Lot 1, Block 13, Sylvan Park Addition, also known as 424 S . Snelling Avenue, St. Paul. The fee paid in this instance was $30 and was paid on May 11, 1967. This application for rezoning was subsequently withdrawn prior to reaching the Zoning Board for action. Section 64.06 of the Zoning Code states that if a petition for an amendment, supplement, change or repeal of the regulations prescribed for a district or part thereof is referred by the Council to the Board of Zoning and then withdrawn at the request of the petitioner prior to the time the Board of Zoning files a report with the City Council, the Council may at the request of the petitioner, grant a refund of the filing fee not to exceed 50/ of that filing fee. . Snelling Ave., St. Paul On May 11, 1967 a petition to rezone the above described parcel of ground was filed with the City Clerk of the City of St. Paul and a f'iling fee of $30.00 paid. No consent petition was filed, as the Corporation Counsel had indicated at that time that consent petitions were no longer legally required as the State Statute was invalid as being unconstitutional. However, the District Court of Ramsey County subsequently determined that the State Statute was valid, and that no rezoning petition could be considered without the necessary consents being filed. By reason of the foregoing, this petition was never processed beyond the City Finance Department, which, of course, held it legally insufficient due to lack of signatures. We have now filed a zoning appeal as to the same parcel under City Ordinance 6�+.03, Subdivision "N", so as to permit the construction of a greenhouse on the property, and have paid a �20.00 filing fee. It is requested that you authorize the return of the $30.00 filing fee on the rezoning. The $30.00 was paid by check and I received receipt #111, dated May 11, 1g67, from the City Clerk's Office.
