Area, the said area shown on the attached map, which is incorporated herein by reference, and commonly described by the following boundaries: From the intersection of Osceola St. and W. 7`� St. northwest to Jefferson, from Jefferson east to Erie, from Erie south to 7ames, from James east to Duke, extending from Duke south to Randolph, east on Randolph to Shepard Road, west on Shepazd Road to Sumac St., extended northwesterly on Sumac St. to Stewart St., then jogging to Osceola St., and then north on Osceola to the beginning point; and WFiEREAS, the said redevelopment plan is the result of a study undertaken by the planning commission in 2002 and 2003 for the purpose of examining land use and zoning along the Riverview Transit Corridor, a segxnent of which included the said West 7`" - Randolph - A.D.M. Area; and WHEREAS, the planning commission reported its schematic redevelopment plan to the City Council in January 2004 and the City Council is presently revaewing the plan's recommendations for adoption as part of the Comprehensive Plan while the planning commission, in 20�4, will make recommendations to the City Council to rezoning various parcels of land within the said study area; and WHEREAS, development within the said study area, undertaken before the said study and rezoning recommendations have been completed and acted upon, could result in land uses which would not be consistent with the City's ongoing goals or its present requirements under the land use plan or comprehensive plan as several properties within the said area are occupied by aging, low intensity and industrial uses which contain great promise for redevelopment; and WHEREAS, the potential for incompatible or inconsistent development within the said study area raises substantial questions relating to the ability of the City's present official controls to provide compliance with the comprehensive plan; and WHEREAS, in light of the pending study of the said area and for the purpose of identifying an overall vision for this area and for the immediate need to preserve the status quo with respect to land use within the study area and to protect the general health, welfare and safety of the public pending the conclusion of the said study, the Council of the City of Saint Paul desires to immediately temporarily prohibit development on any pucel of land ar part thereof within the boundaries of the said study area until such time as the aforementioned study has been completed and the Council of the City of Saint Paul has taken action on the recommendations contained therein: NOW, THEREFORE, BE TT RESOLVED, that under a sepazate ordinance, the Council of the City of Saint Paui 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 2,4 25 26 will prohibit on any pazcel of land or part thereof within the azeas of the West 7`� - Randolph - 0 ��� 5 A.D.M. Study Area as described herein, the issuance or approval of zoning and building permits, piat appxovals or lot splits, until the expiration of twelve months as provided in Minn. Stat. § 462355, Subd.(4), or until such earlier tinne as the Council of the City of Saint Paul has taken action on the recommendations contained in the study; AND, BE TI' FURTE3ER RESOLVED, that pending the adoption of the interim ordinance prohibiting any development inconsistent with the pending study and any amendments to the City's zoning code within the boundaries of the described areas, no zoning or building permits, plat approvals or lot splits may be issued or approved, unless exempted as provided under the ternis set forth in that same separate ordinance noted above, from this date and until the expiration of twelve months as allowed by Minn. Stat. § 462.355, Subd.(4), or until such eazlier time as the Council of the City of Saint Paul has taken action on the recommendations contained in the study; AND BE TT FURTHER RESOLVED, until such time as the said study has been completed and the Council has reviewed its recommendations for possible adoption into the City's official controls, City departments receiving written applications for the approvals noted above shall accept the applications and immetliately process them in accordance with the provisions of Minn. Stat. § 15.99, Subd. 2 and with the intent of this interim ordinance; AND BE TT FINAL,LY RESOLVED, that the restrictions contained in this resolution and in the said interim ordinance may be extended by action of the Council of the City of Saint Paul for those additional time periods not to exceed the time provided in Minn. Stat. § 462.355, Subd. (4) in the event such study and recommendations and the deliberation of the Council requires such extensions of time.
