04-358��..1�s���. �Y'll 1 � �W� RESOLUTION Council File # ��� �$ Resolution # creen sheet # ��/ 3 �7l PAUL, MINNESOTA Presented By Referred To Committee: Date Intent of Ezceptions to TN Height Regulations in the River Corridor Overlay District WI3EREAS, the Mayor and the Planning Commission have submitted and recommended adoption of a majar revision of the Zoning Code (Saint Paul Legislative Code, Chapters 60 through 69) on which the Council held a public hearing on December 3, 2003; WIIEREAS, height standards for new TN Traditional Neighborhood districts recommended by the Mayor and Planning Commission a11ow additional height for buildings set back from side and rear setback lines a distance equal to the additional height, and allow a mazcimum height of ninety (90) feet in the TN3 district with a conditional use permit; WHEREAS, the Mississippi River Corridor Plan, adopted by the City Council as part of the Saint Paul Comprehensive Plan on January 9, 2002, recommends development of additional height regulations in Chapter 68, River Corridor Overlay Districts, of the Zoning Code so that the height of new and expanded structures minimize interference with views of and from the river, as addressed in Secfion 7.2 of the Mississippi River Corridor Plan; however, these additional "permanenY' height regulations for Chapter 68 have not yet been developed; WHEREAS, the new TN Traditional Neighborhood Districts are intended for use for redevelopment sites throughout the city, including use as the underlying zoning for some of the redevelopment sites in the River Corridor that are discussed in Section 73 of the Mississippi River Corridor Plan; WHEREAS, until the additional permanent height regulations are developed, the City Council has decided temporarily to exclude the River Conidor Overlay Districts from TN Traditional Neighborhood District provisions that a11ow additional height for additional setbacks or additional height with a conditional use permit; WHEREAS, once the additional permanent height regulations for Chapter 68, River Corridor Overiay Districts, are developed and adopted, they will govern wherever they are the more restrictive height regulation, and then the temporary language excluding the River Corridor from the normal TN District height provisions will no longer be needed; WHEREAS, in setting the temporary height regulafion for TN zones in the River Conidor, the Council does not intend to downsize any existing redevelopment projects that have already received approval from the Council ar the HRA Board and thus the temporary height regulation contains an exception for redevelopment projects that are working under a signed development agreement with the HRA; o�!�s�' WIIEREAS, the Island Station redevelopmettt although it is not under a redevelopment agreement with the HRA- has gone through neighborhood plauning review and an EAW approval and has begun marketing residential units; WIIEREAS, the height of proposed new development at Island Station has been raised as an issue during the proceedings on the new "TN zoning districts and the Council wants to clarify its intention in acting on the TN height regulations; and WHEREAS, existing Section 62102(e)(2) oFthe Zoning Code allows nonconforming structures such as the Island Station power plan to be enlazged so long as the enlazgement does not increase the shucture's nonconformity; NOW, THEREFORE, BE IT RESOLVED, that the Council intends to delete the temporary exclusion ofthe River Corridor Overlay Districts from the normai TN Traditional Neighborhood Dislxict height provisions once there has been time to develop additional permanent height regulations in Chapter 68, River Corridor Overlay Districts, as recommended in the Mississippi River Corridor Plan; and BE IT FURTHER RESOLVED, that the Council intends that the Island Station redevelopment can make a major buiIding addition with a roofline that is no higher than the unroer roof level at the southerlv corner � � of the historic Island Station power piant (125 feet as the Council understands the measurement), in accordance with Section 62.102(e)(2), which allows the en2argement of a nonconforming building so long as the building's nonconformity is ttot increased.
