The hearing was called to order at 10:12 am.
STAFF PRESENT: Steve Magner, Neighborhood Housing and Property Improvement (I�THPn;
Steve Rice, Planning and Economic Development; Harold Robinson, NHPI
Appeal of Summary Abatement Order at 1664 Minnehaha Avenue East
Harold Robinson reported an order was issued to maintain the yazd free of dog feces. On the
reinspection, the inspector was satisfied the feces had been removed. NHPI notified the owner,
but he still wanted to be heazd here. There is also an outstanding order for an accessory structure
at the property.
Herbert Zimmerman, owner, appeazed and stated he did not know the inspector had reinspected,
and that is why he appealed. He wants to make it clear that he tries to maintain the property.
Mr. Robinson stated he called and spoke to Mr. Zimmerman's daughter.
Ms. Moermond stated the property has been cleaned up by the owner and the order is moot.

Maria Elena Diaz, owner, appeazed and stated the itemswere hauled away. They were left by the
previous owner.
Ms. Moermond asked when she acquired the properiy. Ms. Diaz responded about a yeaz ago,
aithough she cannot remember exacfly.
Ms. Moermond asked was she notified that the City had orders to remove the items, Ms. Diaz
responded that she only got those two letters: one about the hearing today and the other one
about a week ago.
Mr. Magner said a Summary Abatement Order was issued on September 16 to the awners at
1254 Reaney Avenue to remove items and an appliance by September 22. The reinspection
occurred on September 22, the items were still on site, and a work order was sent. Mail was not
returned to indicate the order was not received.

Ms. Diaz stated she came to a hearing and there was no interpreter. Ms. Moermond responded
that Ms. Diaz actually came to the City Council Public Hearing, and not a Legisiative Hearing.
Ms. Moermond does not have a choice but to uphold the assessment. The City did the proper
notification. Maii was not retumed. She can divide the payment of the assessment over a five
yeaz period.
Ms. Diaz stated she will need an interpreter as she plans to appeal to the City Council.
Ms. Moermond stated she would like to see the videotape to see if the door is attached, as this is
important from her perspective.

Ms. Moermond recommends approval of the assessment. She takes a dim view of refrigerators in
backyazds with the doors attached and not chained because of the safety hazard posed to chiidren
who can become enclosed in them and suffocate. This will be part of the report she will file with
the City Council. The City has the authority to move the refrigerator within 24 hours because it
is such a hazard.
(Note: the foliowing week, Ms. Diaz indicated to Steve Rice that she will not be attending the
City Council meeting on March 25; therefore, an interpreter was not scheduied for that day.)
701 Jessamine Avenue East
Dominic Odumuyiwa, owner, appeared and stated this was a new couch. He put it in front of his
porch because his children play on it. The inspector said she did not like the way his wife talked
to her. Mr. Odumuyiwa feels it is good that the City enforces the law so the City will not be
dirty; however, it wouid be sad if the City did it out of hatred. How his wife talked to the
inspector does not matter how the inspector does her job.

Ms. Mcermond asked how long he lived there. Mr. Odumuyiwa responded six yeazs. The City
threw his siding away. What was shown on the videotape was not right. The workers had to call
the police because Mr. Odumuyiwa was offended. The City took the siding and now he cannot
finish his house. He was crying because he had just borrowed money from someone To purchase
the siding.
Ms. Moermond is seeing a notation that there were work crews sent out to this property _
numerous times. Steve Magner responded there were repeated summary abatements at this
properry.
Ms. Moermond asked was there siding on other smnmary abatements. Mr. Magner responded
there was an ongoing file including work to be done on the building. The owner was engaged in

siding his property. It seems to be an ongoing problem since Mr. Odumuyiwa acquired the
properiy in 1998. There has been a repeated cycle of NHPI going back to this property.
Ms. Moermond asked what initiated the inspection in September. Mr. Magner responded they
received a complaint. The inspector issued a suminary abatement for the yazd and to secure the
gazage, which was open.
Ms. Moermond stated she is looking at a history of the City maintaining his property. Mr.
Odumuyiwa responded tfie judge told NHPI to leave him alone because he is working on the
property. Ms. Moermond responded she did not see siding on the videotape. She will refer him
to Risk Management to file a claim if he feels the City took something of value. She asked Mr.
Magner if there is any finding from the court system that the City has been asked to leave Mr.
Odumuyiwa alone so that he can proceed with his rehab work. Mr. Magner responded if the case
was settled, his office would get a court manifold; although, he has never heazd of a judge saying
that.
Mr. Odumuyiwa stated he has alzeady paid a fine on the situation and it was thrown out. Ms.
Moermond responded if he paid a fine, then it was not thrown out.
Ms. Moermond recommends approval of the assessment. She does not know why he is not
maintaining his property. He may get another notice about an assessment for another cleanup,
which is not before her ye�

Marcia Moermond stated it looks like this was an emergency boazding.
Jeff Rager, owner, 9572 206� Street West, Lakeville, appeared and stated he had a gas leak and
the City boarded the windows. He thinks the assessment is too high. There were extensive
repairs to the building. A gas line was removed by Xcel Energy. There were three gas lines to
the buiiding. One was going to the furnace and one to the water heater.
Ms. Moermond stated the total is $379.50. In a lot of cases with a fire, the insurance company
will pay this. Mr. Rager responded the deductible is more than that. They have already
rehabilitated the properiy; it is occupied now.
Ms. Moermond asked would he like the assessment divided over five yeazs. Mr. Rager indicated
he wouid just pay it.

The following appeazed: Kao Yang, owner, and Chao Yang. Chao Yang stated the stove needed
cleaning and they used a propane tank to cook food. He does not know how the fire started. The
fire started in the frying pan.
Mazcia Moermond clarified that the owner was using propane in the house to cook, which started
a grease fire, and it got worse. That is a dangerous situation to have propane inside the house.
She asked the nature of the appeal. Chao Yang responded the owner is grateful for what the City
did. He is on disability and not working. He has a family to support.
Ms. Moermond stated he can go to Real Estate for a form to defer the assessment until the time
the property is sold. It will accrue interest. He can also have the assessment spread over five
years. If he wants to pay it over time, she encouraged him to call her office. He just needs to
decide which he wants to do. He can pay it off ahead of time, too. Steve Magner added that this
should be included as part of the loss; he should talk to his insurance company about this. Chao
Yang responded that there was no insurance.
Ms. Moermond recommends spreading the payment of the assessment over a five-year period.
Chao Yang responded that is fair.

Richard Wybierala, owner, appeazed and stated he has a vacated property with an adjacent lot.
He is rehabilitating it. The chiidren across the street come to the property and play. He put on
three things to hold the door shut so they could not open it. These aze elementary ehildren and
they don't speak English. The cost is exorbitant for putting in three nails.
Steve Magner reported this is a registered vacant building. On October 30, the inspector was at
the property and indicated the front door was open and unsecure. A suminary abatement was

A reinspection was done on November 4 and the situation was the same.

Mr. Menier asked do they notify the tenant. Mr. Robinson responded it varies and is up to the

problems. He has lost thousands of dollazs from being sick. He would like information about
disability.
Ms. Moermond asked were there other compiaints about shoveling. Mr. Robinson responded
December 17. There were grass and weeds on July 2003, and the owner did the work himself.
Ms. Brownell stated they aze tearing up the carpet. They put it under the overhang last summer
They got a notice three days later to clean it up. They aze trying to redo the house.
Ms. Moermond stated if something comes up, it would be helpful for them to connect with a
chore service in the neighborhood. A lot of the district councils have chore services. As for the
deferment paperwork, he can call Real Estate office. The district community council may be able
to help with a chore service.

deferment paperwork, they should give Ms. Moermond a call so that she can change her

Simone Gaede, owner, appeazed and stated she never received notice. She lives there.
Ms. Moermond stated it looks like orders were mailed December 17, 2003 and the work was
done on December 24. The Citizen Service Office sent out the notices. Ms. Gaede responded
she disagrees because her grandmother was coming over this weekend and she made sure there
was nothing slippery. She thought her neighbor sanded. Hazold Robinson reported the notice
was sent from the Citizen Service Office. There was a sanding for 30 minutes. Ms. Moermond
responded it was s trip charge. Sand is not expensive, but time is.

from the Citizen Service Office.

returned mail. Ms. Moermond is not seeing where in the process there was a failure.

Shevada R. Toois, owner, appeazed and stated this was rehabbed. She is doing a lot of work
from the inside. She did not know the carpet was out there. The agreement was that her
stepfather was going to move it. When it was moved, she thought he had picked it up. She did
not want to take a wet tar bucket and put it in her caz. She was waiting for it to dry. She told
NHPI that her yazd is ciean. She has gotten orders before and has taken care of them, but she did
not get one for this. Plus, they took her trash can. She had hardwood floors put into her house.
Marcia Moermond asked does she own the house and have garbage service. Ms. Tools
responded yes to both. There was so much that she was going to have her stepfather do it.

Ms. Moermond stated the City sent orders on November 5, 2003 and did the work on November
17. Ms. Toois responded she got the order for ice after it snowed and but did not get one for
rubbish. She put down salt for the ice. Anytime she gets something, she takes care of it right
away. She was concemed that she kept getting them. The person told her to call right back on
the other person. Ms. Tools says that she does not want to do that, but does want time to take
caze of things she has to do.
Mr. Robinson stated the issue in January was sent by Citizen Service. No action was taken by
the City. No maii was retumed.
Ms. Moermond asked where the Suirunary Abatement Notice went to. Mr. Robinson responded
it was mailed to Ms. Tools at 159 Granite Street and the occupant. The inspector noted that there
is no phone listed for the owner.

Ms. Toois stated she didn't know the carpet was under there. The wind could have blown the
trash on the ground.
Ms. Moermond stated she is looking at a situation where things were left around the house and
not taken care of until someone calls them in. It seems like the City is her property manager and
she needs the City to call her up to take care of basic stuff. Ms. Tools responded she would like a
day to clean up stuff. People are calling on her the time they see a bag outside. She is trying to
make the house look like something. No one wants to put wet tar in their car. In addition, the
man next to her is racist and if he calls her a name again, she will call the police.
Ms. Moermond stated the notice was sent on November 5. She said she did not receive notice.
This notice said it should be cleaned up by November 12. The crew arrived on November 17. In
this case, it would have been one or two trips for the garbage people to come azound. Ms. Tools
responded she never got the notice. There are people in the neighborhood that do not have
anything better to do than mess with other people.
Ms. Moermond recommends reducing the assessment from $323 to $153 plus the $70
administrative fees for a totai assessment of $223 and the payments divided over a five-yeaz
period due to financial hazdship. It is hazd to cut the assessment down when people say they did
not receive notice, but Ms. Moermond sees a history of the owner taking care of notices that she

with her neighbors, especially if racist statements are made.

not specify the appliance. Parks said they picked up a washing machine. On November 2Q Mr.
Vang spoke with someone and gave an extension. On December 1, it was still there on the
reinspection. Pazks went out on December 4 and removed it.
Ms. Bessoner stated she ordered a dump truck. They haul everything from the properry. Twc
men raked the leaves. Mr. Hamilton added that the stove was on public properry on the alley.
