2 BE IT RESOLVED, that, upon the petition of the Velmeir Companies, as documented in Real Estate
3 Division File Number 26-2003, pubiic properties hereinafter described aze hereby vacated and
4 discontinued as public property:

6 That part of the alley in Block 13, Oak Viile Park, lying east of the southerly
7 extension of a line 7 feet east of and parallel to the west line of Lot 4, in said Block 13.

BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntazily on behalf of
Northern States Power Company, d.b.a. Xcel Energy (Gas Division), District Energy St. Paul, Inc. and
District Cooling St Paul, Inc., Comcast of Saint Paul, Inc., Saint Paul Regional Water Services, and the
Department of Publlc Works, made a part hereof by this reference and filed in the office of the City
Clerk of Saint Paul, the City, for itself and on behalf of these corQorations and departments, waives the
right to the utility easements in the vacated azea described above.
18 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
19 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $1200 as an administrative fee for this
vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent right of way easement shall be dedicated by the petitioner, its successors and
assigns on, over, under and across the west seven feet of Lot 4 and east 13 feet of Lot 5, a11 in
Block 13, Oak Ville Puk.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Northern States Power Company, d.b.a. Xcel Energy (Siting and Land Rights Davision).
That a permanent utility easement shall be retained within the vacated uea to protect the interest
of Qwest Corporation.

2 5. At the request of the Office of License, Inspection, Environmental Protection (L1EP), the
3 petitioner, its successors and assigns must provide an access easement to Maryland or Rose and
4 any site plan proposed in around the vacated azea must be approved by LIEP.

7 6. At the request of the Department of Planning and Economic Development, petitioner, its
8 successors and assigns shall conform with Section 67.502 (c) of the City zoning code pertaining
9 to alleys.

12 7. That the petitioners, their successors and assigns agree to indemnify, defend and save hannless
13 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
14 brought as a result of injuries or damages received or sustained by any person, persons or
15 property on account of this vacation or petitioners' use of this property, including but not limited
16 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
17 because of any claims or liability arising from any violation of any law or regulation made in
18 accordance with the law, whether by the petitioners or any of their agents or employees.

21 8. That the petitioners, their successors and assigns shali, within 60 days of the effective date of this
22 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
23 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in

Vacation of part of alley in B1k13, Oak Ville Park
For new CVS Pharmacy at SW corner of Maryland & Arcade
Date: February 18, 2004
The Department of Public Works has completed a review of the above referenced vacation
proposal and has the following requirements:
1) Based on the site plan the petitioners have submitted, we should only be vacating the easterly
155 feet of this alley. This dimension should be verified with the petitioners because I'm just
scaling off their site plan. We recommend, based on their site plan, that we vacate "that part of
the alley in Block 13, Oak Ville Park, lyimg east of the southerly extension of a line 7 feet
east of and parallel to the west line of Lot 4, in said Block 13."
2) The petitioner shall dedicate a permanent 20 foot wide public alley easement from the
remaining existing alley north to Maryland Avenue across the following described property:
"the west 7 feet of Lot 4 and the east 13 feet of Lot 5, all in Block 13, Oak Ville Park."
3) That the petitioner shall construct the alley described in item # 2 to the satisfaction of the
Department of Public Works under an ordinance permit issued by Public Works Street
Engineering.
4) The petitioner shall be responsible far the reconstruction of both ends of the vacation area,
which will be necessary to properly eliminate the appearance of a public thoroughfare, including
but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and signs, all to the
satisfaction of the Department of Public Warks

5) That this vacation shall not be filed with Ramsey County, nor shall the above described
vacation become effective until the site plan submitted by the developer has been approved by
the Depaztment of License, Inspection and Environmental Protection.
Please have the petitioner review the alley vacation limits and location of the new alley to be
dedicated. They need to verify that this will work with their final site plan.
