04-351Return copy to: (jaa} Real Estate Division 140 City Hall Council File # D9 - 35 I Green Sheet # � _`�o ��a RESOLUTION CITY OF SAINT PAUL, MINNESOTA `19 Presented By Referred To Committee: Date 1 BE IT RESOLVED, that, upon the petition of the City of Saint Paul, as documented in Real Estate 2 Davision File Number 13-2003, public properties hereinafter described are hereby vacated and 3 discontinued as public property: 4 5 6 Lots 2 and 3, Block 13, Oak Ville Park; subject to a right of way easement for Maryland Avenue 7 East over, under and across the north nine feet of said Lots 2 and 3. 8 9 10 This vacation shali be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the 11 Saint Paul Legislative Code as amended, and to the following conditions: 12 13 1. 14 15 16 17 18 2. 19 20 21 22 3. 23 24 25 26 27 28 29 30 31 32 33 34 35 That the petitioner's, their successors and assigns shall pay $1,200 as an administrative fee for this vacation and $8,000 as a real estate processing fee, said payment shall come from any proceeds which may be generated by the sale of this property, payment is due and payable within 60 days of the effective date of this resolution. That at the recommendation of the Department of Planning and Economic Development, said property shall be conveyed to the Housing and Redevelopment Authoriry of Saint Paul for development purposes. That any proceeds from the sale of this property, as agreed to by the buyer and the City of Saint Paul, sha11 first compensate the market value of the property to the current owner, any administrative fees and real estate processing fees. Any remaining proceeds will be divided between Department of Public Work's Capital Projects Fund and the Housing and Redevelopment Authority. 4. That the petitioners, their successors and assigns, agree to indemnify, defend and save harmless the City of Saint Paul, its officers and employees from all suits, actions or claims of any character brought as a result of injuries or damages received ar sustained by any person, persons or property on account of this vacation or petitioners' use of this property, including but not limited to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or because of any claims or liability arising from any violation of any law or regulation made in accordance with the law, whether by the petitioners or any of their agents or employees. � 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 oy- 3Sl 5. The remaining land that is located south of the relocated sidewalk on the south side of Maryland is excess property. Public Works is willing to sell this land to the HRA, from what I understand, wouid then sell it to a developer who is interested in property. Proceeds from sale should be deposited in Public Works Capital Projects Fund. The Real Estate Division will coordinate this.
