This is written in response to the appeal of Arthur 0. Schussler
to re ax the density and off-street parking requirements of the Zoning
Code s they apply to property located on the northeast corner of North
Lexin on Parkway and Selby Avenue. This property is further described
as Lo s 15, 16, and 17, Block 3, Roger's Addition to Saint Paul.
These matters were considered at the December 19, 1968 Board of
Zonin meeting. The staff reported that the Zoning Administrator has
notif ed the appellant that the property has not been in conformance
with he approved plans for the site and also that the property is in
viola ion of the Zoning Code inasmuch as the structure contains more
units than allowed by the land area; off-street parking is deficient and,
in ad ition, parking for the apartments has been taking place on the City
boule ard by some 23 feet. It was also noted that in 1963 an appeal was
grant d to relax the density requirements to allow a ten-unit apartment
build"ng, and a permit was granted to install a ten-car parking lot in
conj ction with this use. The structure was apparently converted to
11 un' s during, or short]��r-after cors truction. The appellant requests
that e current use of ll units be allowed and that off-street parking
requi ments be relaxed. Plans have no�k been submitted indicating the
number of off-street parking spaces that can be provided. The permit
grante in 1963 shows ten spaces, but actual construction of the apart-
ment b ilding limits available parking to nine cars.
In regard to the request for a density relaxation it was noted that
the Zo ing Code requires 13,200 square feet of area in a "C" Residence
distri t for eleven units. Thia property, however, contains only 9,673
square feet or a shortage of 3,527 square feet or 26.7 percent. The approved
use of ten units represents a variance from present standards of 2,627 square
feet o 21.4 percent. Under present standards this site without appeal
would ermit onky-six uni�Cs. A letter from the Housing and Redevelopment
Author ty was noted which indicates that one of the basic reasons a renewal
projec is necessary is due to the Code violations that have occurred over : :.�

Mr. Schussler, the appellant, said that he had purchased the
prop rty and was not aware that it was in violation and that he would
like to keep the 11 units.
It was the finding of t3�e Board of Zoning that no additional
vari ces should be granted for this property and, therefore, recommends
that oth appeals be denied.

no in conformance with approved plans for the site. On October 22, 1968
� he was also noted that the property was in violation of tne Zoning Code in

wa considsred in July, 1961 but later the pztition was declared insufficier.t
On March 23, 1903 ari appeal was granted to relax the der.sity requir2m�nts to
� pe mit a_�ten unit apartm�nt building and a permit was granted to install a
� te car parking lot in conjunction witn this use. The structure was apparently
