I Nominations were opened for Vice Chairman. Arthur Tieso w s nominated as Vice Chairman. Nominations were closed. Arthur ieso was elected as Vice Chairman by a vote of 4 to 0 . The appeal of Elaine Sheirich was continued. Mr. Anderso stated that the Housing Authority had no immediate plans f r the West Midway area in which 2273 Long Avenue was located Mr. Norrgran and Mr. Kill of the fire department related their knowledge and experience of fires in frame buildin s that contain third floor occupancies . It was found that th third floor occupancy at 2273 Long Avenue violated Chapter 54 . 15 (3) of the St . Paul Legislative Code which states , "No woo frame dwelling or multiple dwelling shall be occupied above t e second floor for living or sleeping purposes except where t e original construction provided for such type of occupan y. " ♦ ,. y' y � �� Mr . Coh n moved that Mrs . Sheirich be granted a waiver of the above p ovision of the Legislative Code under the following concliti ns : 1 . That a good and sufficient fire escape which would conform to Building Code standards shall be installed to the third floor within 60 days . I 2 . That Mrs . Sheirich as owner of 2273 Long Avenue shall live in such third floor occupancy. 3 . That upon sale of the building at 2273 Long Avenue the third floor occupancy shall be vacated and the building shall be reverted back to a duplex and that such conditions be noted by the Building Department on the Cer- tificate of Occupancy to be issued Mrs . Sheirich. Mr. Cohen further moved that if the above conditions are not followed, the appeal shall be considered as having been denied. Motion carried 5 to 0 . Robert J . Warner appealed to the Board about housing and bui ding code violations at 704 and 706 Wells . Mr. Cohen moved t at the matter be tabled until the next meeting pending a reins ection of 704 and 706 Wells by the Health and Building Departm nts . Mr. Cohen further moved that Mr. Schnarr be present at the next meeting. Motion carried 5 to 0 . The appeal of Lawrence Larson of 1670 Englewood was wit drawn. Mr. Cohen read an opinion from the Corporation Counsel dated March 27 , 1969 which stated that an appeal of a final d cision of the Board can be made to the District Court only an that the length of time allowed to appeal such clecisio is the same as that allowed in any civil suit . Mr. Cohen then read a Supreme Court decision from the Februar , 1969 issue of the "Journal of Housing" about the relatio ship of tenants , living in buildings with Housing Code de iciencies , to their landlords .
