1 BE TT RESOLVED, that, subject to the herein statsd exceptions and with the accompanying Utility Easement Certificates of
2 Intended Non-Use, filed voluntarily on behalf of Qwest Corporation, Northern States Power Company, d.b.a. Xcel Energy,
3 Dish-ict Energy St. Paul, Inc. and Dish Cooling St Paul, Inc., MCI Network Services, Inc., Comcast of Saint Paul, Inc.,
4 Saint Paul Regional Water Services, and the Department of Public Works, made a part hereof by this reference and filed in
5 the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these corporarions and departrnenu, does hereby
6 waive the right to the utility easements in the vacated azea described below.
7 that part of the alley in Block 2, Wifelburg Hills lying westerly of the northerly extension of the east line of Lot 23,
8 said Block 2, and lying easterly of the northerly extension of the west line of the said Lot 23.
9 Any improvements in the above described azea sha11 not interfere with its existing facilities or prevent access by Qwest
10 Corporation to ffie said facilities to maintain, repair or replace them. Should the said improvement in any way interfere with
11 or prevent access to the said facilities, the petitioner or its successor shall provide new easements as required, and the
12 petitioner or its successor shall assume all costs of relocating the said facilities to the new easement:
13 Any improvemenu in the above described azea shall not interfere with its existing facilities or prevent access by Comcast of
14 Saint Paul, Inc. to the said facilities to maintain, repair or replace them. Should the said improvement in any way interfere
15 with or prevent access to the said facilities, the petitioner or its successor shall provide new easements as required, and the
16 petitioner or iYS successor sha11 assume all costs of relocating the said facilities to the new easement:
17 The petitioners, their successors and assigns agree to indemnify, defend and save harmless the City of Saint Paul, its officers
18 and employees from all suits, actions or claims of any character brought as a result of injuries or damages received or
19 sustained by any person, persons or property on account of this release of easements or petitioners' use of this property,
20 including but not limited to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
21 because of any claims or liability azising from any violation of any law or regulation made in accordance with the law,
22 whether by the petitioners or any of their agents or employees.
