Dear Mr. Dalglish:
(1) The undersigned Petitioners, Herbert F. Chase
and Ernst A . Jaffray, respectfully request to exclude from
the Preliminary Order 2LI-2 52� approved March 11, 19 9, which
proposes to :
"construct and/or reconstruct the sidewalk
on both sides of Davern Street from Highland
Parkway to Randolph Avenue"
�hat portion which provides for the new construction
of a sidewalk on the East Side of Davern Street extending
between Bayard and Hartford Avenues .
(2) Petitioner Herbert F. Chase is the owner of a
sinole family residence located at 16g6 Har�ford Avenue;
Petitioner Chase 's property direetly abuts the proposed side-
walk area at Davern Street extending north from the alley to
Hartford Avenue; Petitioner Jaffray is the owner of a single
family residence located at 1697 Bayard Avenue, said property
directly abutting the proposed sidewalk area at Davern Street
extending south from the alley to Bayard Avenue. There is no
proper� owned b� others directly abutting the area o� the
proposed new sidewalk construction on the East Side of Davern
Street betcaeen Hartford and Bayard Avenues .
(3) During the past quarter of a century the neigh-
borhood was able to live without a concrete sidewalk on the
East Side of Davern Street. The proposed sidewa.lk area in
question is now seeded with lawn, which is properly tended,
attractive to the eye and does not constitute a safety hazard.
The neighborhood is static; there is no significant pedestrian
traffic on Davern Street nor has there been any in �he past.

In Petitioners � opinion, any such pedestrian traffic as now
exists will decrease ra.ther than increase.
(�) In summary, Petitioners verily believe that
there never has been and is not now any need or requirement
for a. concrete sidewalk on the eastern side of Davern Street
(between Bayard and Hartford Avenues) and that no such future
need is anticipated.
The undersigned Petitioners ask for due consideration
of their joint petition and respectfully request you to
EXCLUDE from Order 242 52� any construction of a new
sidewalk on the East Side of Davern Street between Bayard and
Hartford Avenues .

The undersigned Petitioners , Herbert F. Chase
and Ernst A. Jaffray, respectfully request to exclude from

Petitioner Herbert F. Chase is the owner of the
single family residence located at 1696 Hartford Avenue;
Petitioner Chase's property directly abuts the proposed side-
walk area at Davern Street extending north from the alley to
Hartford Avenue; Petitioner Jaffray is the owner of �he single
family residence located at 1697 Bayard Avenue, said property
directly abut�ing the proposed sidewalk area at Davern Street
extending south from the alley to Bayard Avenue . There is no
�roperty owned by others directly abutting the area of the r
proposed new sidewalk construction on the East Side of Davern
Street between Hartford and Bayard Avenues .
During the past quarter of a century the neighbor-
hood was able to exis� without a concrete sidewalk on the
East Side of Davern Street . The proposed sidewalk area in
question is now seeded with lawn, which is properly tended,
attractive to the eye and does not constitute a safety hazard.
