PAUL FOENCIL NQ. t • OFFICE OF THE CITY CLERK OUNCIL RESOLUTION—GENERAL FORM PRESENTED BY COMMISSIONE DATF In the Matter of hazardous buildings being that one and one—half story frame single—family dwelling and 16x16 foot shed known. and described as 722 Joy Street in the City of Saint Paul and situated upon those premises legally described as Lot 2, Block 2, Cox' s 2nd Addition, according to the plat on file and of record in the office of the Register of Deeds in and for the County of Ramsey, State of Minnesota. WHEREAS, Pursuant to resolution, C. F. No. 242470, approved March 6, 1969, a public hearing was duly held on Tuesday, March 18, 1g6g, and said hearing was continued to April 15, 196g, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the � structure located at 722 Joy Street, Saint Paul, Minnesota; and WHEREAS, Upon the facts presented at the said hearing consisting of photographs, inspection reports and the recommenc�tion of the Gity Architect, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record owner of the above—described property is Clara Kuehn, deceased; and that there are no other lien holders of record; an.d that it is further determined that the above—described buildings constitute hazardous buildings within. the definition. of Minnesota Statutes Section 463. 15 for the following reason.s: FORM � PROV a , COUNCILMEN Adopted by the Councii 19.— Yeas Nays Carlson Dalglish Approved 19—_ Meredith Tn Favor Peterson Sprafka Mayor Tedesco A gainst Mr. President, Byrne O - " - . � 24����- Page 2. a. The dwelling is standing vacant and has been extensively damaged by vandals; b. The exterior condition of the dwelling is as follows : the top of the chimney has fallen off the building; the front concrete steps have crumbled; the roof o� the rear addition is collapsing; the front porch sills are rotted out; the rear porch is sagging and the floor is rotted out; the siding on the addition was n.ever finished; and the rear part of the building is sitting on the ground with no foundation and is badly rotted; c. The interior condition of the dwelling is as follows : the floor, ceiling and roof on the rear addition are rotted out; on the first floor, all the win,dows and doors have been smashed by vandals ; the wall plaster is loose and in danger of falling; and the fireplace has been destroyed by vandals, with only the brick parts remaining; on the second floor, all windows and window sashes are broken, plaster is loose and in danger of falling; the plumbing system has been c�ompletely vandalized; all the �ixtures have been. smashed and the hot water heater has been torn out; the building had no city sewer system; it was serviced by a well and septic tank of unknown condition; the electric service has been disconnected and the system has been damaged and not in any condition to be put back in service; there is no heating system in the building; d. The 16x16 foot shed is built into the hill at the rear; the shed is badly rotted, standing open and in danger o� immediate collapse; e. The in.terior of the dwelling is littered with con.siderable debris an.d trash; f. The buildings in their above conditions are beyond reasonable repair; � ' - ,� - 24����- Page 3. g. The dwellin.g is unfit for human habitation in its present condition and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; h. The buildings constitute nuisances and hazards to the public health, safety and welfare because of their physical damage, dilapidation and inadequate maintenance; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463. 15 through 463. 26, and based upon the �oregoing findings of the City Council , the Council of the City o� Saint Paul does hereby make the following Order: ORDER l. The owner of the above—described buildings shall make the same safe and n.ot detrimental to the public peace, health, safety and welfare by having the said buildin.gs razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order. 2. Unless such corrective action is taken to comply with this Order or an answer served upon the City o� Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcemen,t of this Order to raze and remove the said buildings will be made to the Ramsey County District Court. 3. If the Gity of Saint Paul is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the above—described real estate and collected as other taxes; and be it FURTHER RESOLVED, That a certified copy of this resolution and incorporated Order herein be served upon the last record owner of the above—described property in the manner provided by law and also upon other interested parties in the manner provided by law. The property has a 16x16 ft. shed built into the hill at the rear. The building is bad.ly rotted, standing open and in d.anger of immediate collapse. There is an open cave at the rear of the property with a deep hole into the hill. The entire yard is littered with trash and junk, estimated to be approximately s ix truckloads. Inasmuch as a rehabilitation schedule has not been submitted by the owner, it is the conclusion of the Bureau of Public Buildings that by reason of inadequate maintenance, dilapid.ation, physical damage, unsanitary condition and abandonment, the above structure constitutes a hazard to public health, safety and welfare. Byrne, Mayor and Members of the City Council Re: File No. 1942--722 Joy 5treet Gentlemen: The Building Department is hereby submitting its report on the condition of the property known as 722 Joy Street, a single family dwelling of frame construction, 1-1/2 stories in height with no basement. The build.ing is approximately 37 ft. wide, 48 ft. long and 21 ft. high. The building is standing vacant and. has been extensively d.amaged by vandals. The top of the chimney has fallen off the building. The front concrete steps have crumbled., and the roof of the rear ad.d.ition is collapsing. The front porch sills are rotted out, the rear porch is sagging and the floor is rotted out. The sid.ing on the addition was never finished The rear part of the building is sitting on the ground. with no found.ation and is badly rotted. The owner of record is the deceased Clara Kuehn, and the legal description of the property is Lot 2, Block 2, Cox's 2nd. Ad.d.ition. A recent inspection indicates the following condition of the interior: FIRST FLOOR. Contains four rooms and bath. The floor, ceiling and roof on the rear addition are rotted out. All the windows and doors have been smashed by vandals. The wall plaster is loose and in danger of falling. The fireplace has been d.estroyed by vandals, with only the brick parts remaining. SECOND FLOOR. Contains two rooms. All windows and. window sashes are broken. Plaster is loose and. in danger of falling. The plumbing system has been completely vandalized,.
