WHEREAS, Pursuant to resolution, C. F. No. 241768,
approved January 17, 196g, a public hearing was duly held
on Thursday, January 30, 1969, before the Council of the
City of Saint Paul , and was continued to Thursday, March
2'7 , 1969, said hearing pertaining to the condition of the
structure located at 118 North Western Avenue, Saint Paul,
Minnesota; and
WHEREAS, Upon the facts presented at the said hearing
consisting of photographs, inspection reports and the recommenda-
tion of the City Architect, it is found and determined by the
City Council that according to the records and files in the
office of the Register of Deeds, the last record owners of the
above—described property are Wallace L. Fritz and Doris E.
Fritz; that Northwestern National Bank is t e mortgagee; and
that there are no other lien holders of re rd; now, ther�ore,
be it

RESOLVED, That the Council of the City of Saint Paul ,
after hearing the matter concerning the building located at
118 North Western Avenue, does hereby declare that the said
building does constitute a nuisance to the public and does
order that the owners abate the nuisance by removing the
building in the shortest time possible; be it
FURTHER RESOLVED, That the Council of the City of Saint
Paul does further determine that the above-damaged building
constitutes a hazardous building within the definition of
Minnesota Statutes Section 463. 15 for the following reasons :
a. The building has been extensively
damaged by fire, is standing vacant , open and
is subject to entry by unauthorized persons ;
b. That because of the dangerous con-
dition of the interior of the building, it
constitutes a potential hazard and appears
to be unsafe for entry by anyone;
c. The interior of the building is
completely damaged by fire and is beyond
reasonable repair;
d. The interior of the building is
littered with combustible material;
e. The buildin.g is unfit for human
habitation; and if the structure is to be
rebuilt, it must be brought into compliance
with the Building and Housing Codes of the
City of Saint Paul ;
f. The building constitutes a nuisance
and a hazard to the public health, safety and
welfare because of its physical damage,
dilapidation and inadequate maintenance;

FUR.THER RESOLVED, That in accordance with Minn.esota
Statutes Sections 463. 15 through 463. 26, and based upon the
foregoing �indings of the City Council , the Council of the
City of Saint Paul does hereby make the following Order:
ORDER
l. The owners of the above-described building shall
make the same safe and not detrimental to the public peace,
health, safety an.d welfare by having the said building
razed and the materials therefrom removed �rom the premises
within twenty (20) days from the date of the service of this
Order.
2. Unless such corrective action is taken to comply
with this Order or an answer served upon the City of Saint
Paul and filed in the Office of the Clerk of the District
Court of Ramsey County, Minnesota, within twenty (20) days
from the date of the service of this Order, a Motion for
Summary Enforcement of this Order to raze and remove the
said building will be made to the Ramsey County District
Court.
3. In the event that the building is to be razed by
the City of Saint Paul pursuant to judgment of the District
Court , all personal property or fixtures which may unreason.-
ably in.terfere with the razing and removal of this building
shall be removed within, ten (10) days from the entry of
judgment; an.d if not so removed, the City of Saint Paul
shall remove an.d dispose of such personal property and fix-
tures as provided by law.
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by
the City will be assessed again.st the above-described real
estate and collected as other taxes ; and be it

Gentlemen:
The Building Department is hereby submitting its report on the
condition of the property known as 118 North Western, an apartment building
of ordinary construction, three stories high with a full basement. The
building is "L" shaped., with the largest dimension being 111 ft. and the
width of each wing being 39 ft. This building was severely damaged by
fire on December 31, 1968 to the extent that the roof has been completely
burned. off and has collapsed into the interior of the building. The exterior
masonry walls show evidence of severe d.amage, both from the fire and.
the overloading of ice from the firemen's hoses. The fire apparently originated.
in the lower level and the basement is gutted by fire and. is unsafe to enter.
The owner of record is Dr. Wallace L. Fritz and the legal description
of the property is Lots 25 and 26, Block 74, Dayton & Irvine's Addition to
Saint Paul.
A recent inspection indicates the following:
The first floor was severely d.amaged. by fire and the ceiling is so
overloaded with ice that it is in d.anger of collapse.
The second. floor conditions are the same as the first except that the
overload.ings of the floors are more extreme due to the collapsing of the entire
roof structure. Also, sections of the second floor have been completely burned.

The third floor has been completely destroyed and it is unsafe to
enter to make a detailed. inspection.
The plumbing, electric and heating systems have been damaged by fire,
water and exposure and can no longer be considered. salvageable or functioning.
There were no accessory build.ings on the property.

We have attempted, with limited success, to have the building
properly secured to prevent its entrance by unauthorized persons. On
January 10, 1969, per Council File N�. 241653, the City Council instructed
the Public Works Department to secure the property. However, two hours
after the Council's action, we were able to convince the owners of their
responsibility to keep the property secure, and they agreed and have taken
steps for temporarily securing the structure pending the outcome of this
hearing. Based on that agreement, we then requested the Public Works
Department to hold. off their crews temporarily. This was done with the advice
and counsel of Mr. Jerome J. 5ega1 of the Corporation Coun�el's office, who
met on the site with Mr. Walter Fritz, son of the owner, and Mr. Steve Fisher,
representing the owner's insurance company, and Mr. 5amuel Blue of this
offic e.
The present condition of the building is such that we consid.er it
beyond. reasonable repair and a serious hazard d.oes exist due to extensive ice
build-up com�pletely covering the ix� erior and exterior of the building. Inasmuch
as a rehabilitation schedule has not been submitted by the owner, it is the
conclusion of the Bureau of Public Buildings that by reason of inadequate
maintenance, physical d.amage and abandonment, the above structure constitutes
a hazard to public health, safety and welfare. It is hereby recommended
that the Council concur in this conclusion and refer the matter to the City
Attorney's office for submission of this matter to the District Court.

Gentlemen:
Dr. Wallace Fritz wants the city to pay for his burned out
apartment building at 11g N. Western �ve. He wants us to wreck it now
because it is of no value to him. If we are going to do that let us wreck
the rest of the property that he and his brother Bryant and his sister
own. Or shall we wait 20 years and do it?
I und�rstand Dr. Fritz and his brother Bryant own two houses on
Edmund Avenue, one at 929 and the other at 981 or 983. Believe me I have
had to look at the one at 929 for 7.l�, years. They are real slum lords.
All they want to do is to collect the r�nt.
I just saw RED when I read this in the paper tonight.
I wonder what the rest of the neighbors think of it?
I sure want to cong�adulate Cammissioner Tedesco and N�yor
Byrne for chastizing Dr. Fritz.
I would sure lil�e you gentlemen to look at these houses
I mentioned. Talk to him about them. Dr. Fritz was born at
929 �dmund as I understand it. Beleive me they have really milked
these two homes .
Anything you Esan do wi11 be appreciated. 929 was painted about
lg years ago. Maybe Dr. Fritz would like you to paint it for him too.
