payment having been approved by the City Architect, a copy
of said approval being hereunto attached and made a part
hereof.

Gentlemen:
On March 19, 19b9, the Council referred to me for reply a
letter from Richard. Coverd.ale dated March 19, 1969, regarding refund
of a fee filed for an appeal for a d.ensity relaxation of the above-
described property.
Section 64. O6 of the Legislative Code states that the Council in
its d.iscretion may grant a refund of the filing fee not to exceed 50 per
cent of that filing fee if the appeal is withd.rawn at the request of the
petitioner prior to the time the Board. of Zoning files a report with the
City Council. In this case, the above described matter has not been
referred to the City Council by the Board of Zoning, and therefore it is
my opinion that the Council may refund. to Mr. Coverdale 50 per cent of
his original filing fee.
