OFFICE OF THE,�CITY CLERK ' OUNC L U —GENERAL FORM PRESENTED BY COMMISSIONE DATF WHEREAS, The City o aint Paul by resolution, Council File No. 235917, approved November 29, 1967, condemned and took certain lands for the opening and widening of the Arch-Pennsylvania Highway described as follows: All that part of Lot 5, Irvine's Addition of Outlots to the Town (now City) of St. Paul, Ramsey County, Minnesota, described as follows: Commencing at a point on the Easterly line of said Lot 5, 101z feet south of the northeasterly corner of said lot, thence Southerly on said easterly line 101z feet, thence westerly at right angles 82' feet, thence northerly at right angles and parallel to said easterly line of said lot, 1012 feet, thence easterly at right angles 822 feet to the place of beginning, except that portion of said premises conveyed to the City of S�t. Paul, a municipal corp. in and by that certain Warranty Deed dated June 25, 1925, recorded on ' June 26, 1925, in 761 Deeds Page 141 and subject also to any change in the size of said property caused by the vacating, opening, widening or nar.rowing of any street or alley� and WHEREAS, through inadvertence, the Naegele Outdoor Advertising Company, Inc. was not compensated for its leasehold interests in and to such land, and WHEREAS, the Committee on Lands composed of the Mayor, the Purchasing Agent, the Commissioner of Finance, and the Commissioner of Public Works, has negotiated a seftlement in the amount of $2,100.00 with the Naegele Outdoor Advertising Company, Inc. representing total and full compensation for any and all interests of the Naegele Advertising Company, Inc, as evidenced by letter of said committee submitted herewith, now, therefore be it RESOLVED, that the proper City officials are hereby authorized and directed to pay to Naegele Outdoor Advertising Company, Inc. , lessee of the lands described as follows: EORI� �� CorPa� COUNCILMEN Adopted by the Council 19— Yeas Nays Carlson �a}l. The City of Saint Paul by resolution, Council File No. 235917, approved November 29, 1967, condemned and took this land for the opening and widening of the Arch-Pennsylvania Highway. Through inadvertence, the Naegele Outdoor Advertising Company, Inc. , was not compensated for its interests in the said land. We, the Committee on Lands, do recommend to the Council of the City of Saint Pau17 that it authorize the payment of $2,100.00 in damages to the lessee as compensation for all its right, title and interest in the said land as negotiated with said party.
