Resolution MemorialiZing Council Decision of February I8, 2004 to
Order the Removal of 837 East 4`" Street within 30 Days and
Revoking the $2, 000 Performance Bond Posted to Pull Permits on a Nuisance Building
1 WI3EREAS, the Saint Paul City Council on September 3, 2003, in CF# 03-696, granted Dorothy Lyons 90
2 days to complete the rehabilitation of 837 East 4"' Street; and
3 WHEREAS, the Council has received regular progress reports from its Legislative Hearing Officer on the
4 rehabilitafion of this structure since December 3, 2003, the expiration of the 40-day time period; and
5 WIIEREAS, the Legislafive Hearing Officer reports that the property owner has a history of requiring City
6 intervention to maintain this property and she has shown limited competency in conducting the
7 rehabilitation of the property; and
8 WFIEREAS, at its most recent update from the Legislative Hearing Officer the Council was informed that
9 180 days had past since the original posting of the $2,000 performance bond to secure building permits for
10 the rehabilitation of the structure,
11 WHEREAS, License, Inspection and Environmental Protection (LIEP) staff monitoring the building
12 rehabilitation and permits indicated in the February 10, 20041egislative hearing that significantly less than
13 the required 50% of the rehabilitation of the structure was completed at the 180 day juncture; now therefore
14 be it
15 RESOLVED, that the City Council hereby requests LIEP to communicate the revocation of the $2,000
16 perforxnance bond; and be it further
17 RESOLVED, that the City Council orders the removal of 837 East 4�' Street within36�days of the
18 publication of this resolution.
