THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Gode, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain pro-
perties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the following
described property from "A" Residen.ce District to "C" Residence
District, to-wit:
Lots 26 through 30, Block 8, Hager' s
Subdivision of lots 1, 2, 3, 4, 5, 6,

Dear Sir:
This is w�itten in response to the petition of Richard Sagstetter to
rezone from "A" Residence to "C" Residence, �roperty located on the
southwest corner of Sylvan Street and Arl.inatan Avenue. This Aroperty is
furthe� described as Lots 26 throuc;h 30, Block 8, Ha�?er's Subdivision of
Lots ]. throu�?h 7, 14 throu�?h 18 of 6�ialcott's Addition to Cottage Homes.
This matter was considered at the February 20, 1969 Board of Zoning
meetina. The staff renorted that the �x�000sed use is a 28-unit a�artm�nt
building. It was noted that this �roperty was rezoned from "A" Residence
to Light Indust�y in 1946 and back to "A" Residance in 1965. The site
contains 29,500 square f eet and is presently occuoied by a deteriorating
sin�le-famil;� residence. A].thou�h apartment uses e�.st across Arlin�ton
Rvenue, a �horough.fare with a co�.lector status, it was noted that the
Comprehensive Plan calls for low density residential use of this *�roperty,
existin�; development south of Arlinpton Avenue has been low density and the
rezonin� back to "A" Rasidence in ].965 was to pres2rve the existing character
of the area.
G�Ir. Sa�stetter, the petitioner, explained that the real purpose of the
rezonin� back to "A" Residence was to lower the assessment for street
improv�nents, that the prooerty is in need of renair and that he felt that
anartment zoning for the pronerty would be rnuch better.
Mr. Dou�].as Andrews, part owner ot the r�mainder of the block, stated
that he felt the whole block should be rezoned to Ligh�C Industry and req_uested
that the matter be laid over to allvw him to brino in a petition to rezone
to T,iaht Industry and devel.op a sma11 industrial pa.rk on the block.
After further discussion, it was the findin�; of th e Board of Zoning that
