Under Mimi. Stat. § 299A.01, Subd 2(4), the State is empowered to enter urto this Grant Agreement. By written acceptauce below, the Grantee agrees to perform the work within the terms and conditions in tlus Annual Plan Grant Agreement, including Attachment A, which is attached and incorporated into this Grant Agreement. The Grantee must sign its approval in the designated signature block and retum the original signed Grant Agreement and its attachments to the address shown below, prior to the commencement of services. The services to be provided under this Grant Agreement aze the NightCAP Grant Program, Attachment B, which is attached and incorporated into this Grant Agreement. Agreement Begin Date: 11/29/03 Agreement End Date: 1/1/04 The Grantee will be reimbursed an amount not to exceed $2400.00 for the above services performed under this Grant Agreement. Attachment A Attachment A L� Conditions of Payment All services grovided by the Grantee under this Annual Plan Crrant Agreement must be performed to the State's satisfacrion, as determined in the sole discrerion of the State's Authorized Representative and in accordance with all applicable federal, state, and local laws, ordinances, rules and regulations. The Grantee will not receive payment for work found by the State to be unsarisfactory, or performed in violation of federal, state or law. 2. Cancellation This Annual Plan Crrant Agreement may be canceled by the State at any lime, with or without cause, upon thirry days' written norice to the Grantee. Upon temvnation, the Grantee will be entiUed to payment, detemiined on a pro rata basis, for services satisfactorily performed. ` 3. Amendments Any amendment to this Annual Plan Grant Agreement must be in writing and will not be effective until executed and approved by the same parties who executed and approved the original grant agreement, or their successors in office. 4. Liability The Grantee must indemnify, save and hold the State, its agents, and employees ham�less from any clanns or causes of acrion, including attorneys' fees incurred by the State, arising from the perfomiazice of this Annual Plan Grant Agreement by the ('rrantee or the C,rantee's agents or employees. This clause will not be conshued to bar any legal remedies the Grantee may have for the State's failure to fulfill its obligations under this Annual Plan Crrant Agreement. 5. State Audit Under Minn. Stat. § 16C.05, subd. 5, the Grantee's books, records, documents, and accounting procedures and pracfices relevant to this grant agreement aze subject to examinarion by the State and/or the State Auditor or the Legislarive Auditor, as appropriate, for a minimum of six years from the end of this grant ageement. 6. Federal Audit The Crrantee will comply with the Single Audit Amendments of 1996 and Office of Management and Budget Circulaz A-133. Federal Audit Requirements is incorporated by reference. Government Data Practices Act The Cnautee and the State must comply with the Minnesota Government Data Practices Act, Minn. Stat. Ch. 13, as it applies to all data provided by the State under this gant agreement, and as it applies to all data, created, collected, received, stored, used, maintained, or disseminated by the Grantee under this grant agreement. The civil remedies of Minn. Stat. § 13.08, apply to the release of the data referred to in this clause by either the Grantee or the State. In the event the Cn�antee receives a request to release the data referred to in this clause, the Grrantee must immediately nofify the State. The State will give the Grantee inshuctions conceming the release of the data to the requesting pariy before the data is released. 8. Data Disclosure Under Minn. Stat. § 270.66, and other applicable law, the Crrantee consents to disclosure of its social security number, federal employer tas identificarion number, and/or Minnesota taac idenfification number, already provided to the State, to federal and state tax agencies and state personnel involved in the payment of state obligarions. These identificarion numbers may be used in the enforcement of federal and state tas laws which could result in acrion requiring the Grantee to file state taac rehmzs and pay delinquent state taac liabilities, if any, or pay other state liabiliries. 9. Jurisdiction and Venue Minnesota law, without regazd to its choice-of-law provisions, govems this Annual Plan Grant Agreement. Venue for ali legal proceedings out of this Annual Plan Grant Agreement, or its breach, must be in the appropriate state or federal court with competent jurisdiction in Ramsey County, Minnesota. � oy-a� . ,,,-, NiahtCAP Grant Pro¢ram Grantee's Duties 1 Coordinate alcohoi saturations�with the State's district authorized representative for saturation events to be heid on November 29 and December 20 & 31 2003, providing up to foriy-eight hours of enforcement. 2 All law enforcement officers participating in this program must be Peace Officers Standazds and Trauring Boazd (POST) licensed as provided by Minnesota law. 3 All law enforcement officers participating in this program must be Standardized Field Sobriety Testing (SFST) trained. Grantee must provide proof of training for each officer not currently qualified before such officer(s) will be allowed to participate in the program. 4 All law enforcement officers participating in this program should aggressively enforce iraffic laws with an emphasis on impaired driving. 5 Grantee will provide a list bf eligible law enforcement officers who may participate in this program with their overtnne rate of pay, including fringe benefits, on "Personnel Roster" labeled Attachment C of this grant agreement, which is attached and incorporated and made a part of this grant agreement. Reimbursement will be made only for hours.that officers work on a day off or on a shift extension. 6 Grantee will review Officer Acfivity Reports and Activity Logs (samples attached) to verify work efficiency by those officers working the saturations; officers unwilling or unable to diligently pursue impaired drivers cannot be allowed to work subsequent saturation events and Grantee will work with the State's district authorized representafive to replace such officers with qualified officers. 7 Grantee will complete and submit all required paperwork following each saturation event including, but not limited to, Officer Activity Reports and Invoices to the State's district authorized representafive within seven (7) working days following each saturation event. 8 Grantee will participate in pubiic informafion and media efforts with the State's district authorized representative as a part of each saturation event. 9 Grantee shall provide for all operating costs including, but not limited to, maintenance and repairs of squad cars used in performance of this grant agreement and shall provide all necessary insurance for them. 10 Grantee's law enforcement officers, providing services under this grant agreement, aze employees of the Grantee and not employees of the State or Federal government. 11 State's district authorized representarive is Lt.
