said real estate from "B" Residence District to "C" Residence
District thereunder, be effected, having been initiated by
said Council ; said real estate and other parcels of real estate
having comprised an area of not less- i�han forty acres within
said City, the whole whereof having been made the subjeet of
a survey by the City Planning Board of Saint Paul and said
Board having considered whether the number of descriptions
of real estate affected by said amendment to said Zoning Code

At its regular monthly meeting on December 20, 1968, the City Planning
Board of Saint Paul held its public hearing on a 40-acre study of the
area between Shepard Road and West Seventh Street, west of Elway, as
requested in C.F. 240083.
The notice of public hearing included the consideration of whether a
change of the zoning classification of lands to "co�nercial," "industriai,"
"Multiple,", "duplex," or "single-family" uses within the entire area fell
within the general conditions of a "40-acre" study, as well as a reference
to a proposed change in zoning classification from "B" residence and
"Light Industry" districts to "C" .residence district of an area bounded
generally by Shepard Road or the south, Rankin Street on the east, SLewart
Avenue and a line one-half block north of Stewart Avenue on the north,
and Davern Street on the West.
Under the provisions of the Saint Paul Legislative Code, _Section 64.06,
pertaining to the "40-acre" study provisions, the Boar'd is supposed to
do the following:
1) Consider whether a survey of the whole area .of the City of Saint
Paul, or of an area not less than forty acres had been conducted
" by the Board
2) Consider whether the number of descriptions of real estate affected
by such changes and alterations made the obtaining of written con-
sent impractical
3) Make a finding on one of the following three alternatives:
(a) the proposed amendment is related to existing land uses; or
