WHEREAS, Council File No. 240083, approved September
4, 1968, directed the Planning Board to conduct a survey of
the area generally described as lying between Shepard Road and
West Seventh Street west of Elway, the same being in excess of
40 acres in extent; and
WHEREAS, The Planning Board has filed its report and has
indicated that a change in the zoning classification of
certain lands to "G" Residential is reasonably related to a
plan for future land .use, and that the number of descriptions
of real estate affected by the study make the obtaining of
written consent as otherwise required by law impractical; and
WHEREAS, The Council, after review of the report of the
Planning Board, has determined to consider the change in the
zoning classification of certain lands comprehended within
the aforesaid study to "G" Residential; now, therefore, be it
RESOLVED, That the Gommissioner of Finance be and hereby
is directed to give notice of the hearing to be held on March
20, 196g, for the purpose of considering the advisability of
rezoning from "B" Residential to "C" Residential the following
described property:
Lots 1 through 32, Block 2; Lots 1 through 32, Block 3;
Lots 1 through 32, Block 4; Lots 1 through 15, Block 5;
Lots 21 and 22, Block 5, and Lots 31 through 43, Block 5,
all in Youngmann and Lamm� s Addition, Ramsey County,
Min.n. ; also Lots 16 through 32, Block 9; Lots 17
through 32, Block 10; Lots 17 through 32, Block 11;
and Lots 17 through 32, Block 12, all in Palisade
Addition to Saint Paul.

Gentlemen:
A question has been raised respecting the final paragraph of my letter to '�
you dated January 27, 1969, which reads as follows: .
"In summary: the City Planning Board of Saint Yaul has sur-
veyed the area r�quested by Council and found tne obtaining
of written consent impractical, and feels that a re-zoning
to "C" residential in the area bounded by Shepard Road on
the south, Rankin Street on the east, Stewart Avenue and a
line one-half block north of Stewart Avenue on the north,
and Davern Street on the west, a reasonable actiori to take.".
The phraseology "Stewart Avenue and a line one-half block north of Stewart �
Avenue on the north," is not intended to create an ambiguity about the
northern boundary of the territory described. Rather, it is intended to
confer upon Council discretion to end any ultimate rezoning at the south
side of' Stewart Avenue or to extend it across Stewart to the northerly
back lot lines of those lots facing on the north side of Stewart Avenue,
thus producing the same zoning on both sides of Stewart. �

We feel that to atte�rpt to rezone the proposed area to "C"
residence while excluding the nroperties whose owners have pe-

90.5/0 of the property owners while preserving the fundam�ntal
soundness of the rezoning, it could exclude all properties, in-

Youngman.
We attach an amendment which would accomplish thi� result.
No amendment has been prepared to accomplish the patchwork
rezoning referred to. To do so would require a good deal more
work by Valuations in a5certaining the precise legal descriptions
of the properties involved and, as noted above, would be in my

I presume that the public hearing to which you refer �
is that required by r1.5. 1967 , Sec . 462 . 357 , Subd. 3. It is
our position that ttie hearing required by this statute was
held, pursuant to proper notice, on Thursday, March 20th, 1969,
at 10:00 A.M.
The reported hearing on April 8tfi was not in any way
called by the council . It results primarily from a newspaper
reporter' s conclusion that , since the council customarily has
public hearings on ordinances on the third reading, persons
would be permitted ta be heard on this ordinanee on its third
reading tomorrow. This matter does , however, rest in the
discretion of the council . •

RE: Shepard Road Rezoning '
� The ordinance amending the Zoning Code pertaining to Shepard
Road matter was laid over on May 29, 1969 to Tuesday, June 24, 1969.
The purpose of the lay-over was to add an amendment to the ordinance
which would exempt any property where the o�mer requests that he
desires that property to remain B Residence.
The Mayor requested that anyone wishing to have his property
remain B Residence should contact the Bureau of Valuations and the
necessary legal description will t.zen be� obtained and presented to
this office to be included in the amen�ment.
Anyone affected by the ordinance in its�present form who does
not make his wishes known to the Bureau of Valuations will be included
in the ordinance and his property will be changed to C Residence.

wide—spses�d public attention.

At your meeting of May 29, you laid over third
reading of the Shepard Road rezoning ordinance to June .
24, next Tuesday, to permit those residents of the
covered area who did not wish to have their property
rezoned to get their legal description from the
Valuations Bureau and request our office for inclusion
in an amendment to the ordinance .
As of this morning we have received no such
requests .

few days ' grace to provide time for checking legal

(b) 'the proposed amendment is reasonably related to over-all
needs of the community; or
(c) the proposed amendment is reasonably related to a plan for
future land use.
It was the decision of the Board that a survey of an area not less than
40 acres had been conducted. In this particular case, the study covered
the area encompassed in the City Council's Resolution ��240083 which com-
prised approximately 320 acres. In considering the number of descriptions
of real estate affected, the Board confined its review to the entire
320 acres and felt that the obtaining of written consent was impractical.
Relative to item ��3 above, the Board found the proposed amendment to be
reasonably related to a plan for future land use.
We are attaching h�rewith a copy of the minutes of the City Planning
Board of Saint Paul, of December 20, 1968.
In summary; the City Planning Board o� Saint Paul has surveyed the area
requested by Council and found the obtaining of written consent impractical,
and feels that a re-zoning to "C" residential in the area bounded by
Shepard Road on the South, Rankin Street on the east, Stewart Avenue and a
line one-half block north of Stewart Avenue on the north, and Davern
Street on the west, a reasonable action to take.

Gentlemen:
You directed the Planning Board to study an area encompassing approximately
320 acres, to review the existing zoning and development pattern in this area
in relation to the Comprehensive Plan.

As you can readily see by the underlined portion of the legal notice, the real purpose
of the study is to rezone an extremely small portion of the property on Youngman
Avenue for the purpose of a high rise development on behalf of a private developer.

I am certain that it was not the intention of the Council to use the "40 acre" law to
obviate the necessity of a consent petition of adjoining land owners. However, this �
is exactly what has happened in this case.
A 40 acre study (in this case a 320 acre study) is supposedly to be used sparingly
and judiciously when "the nusnber of descriptions of real estate affected by changes �
and alterations renders the obtaining of written consent impractical", and "shall
have considered whether the number of descriptions or real estate affected by such
changes in alterations renders the obtaining of such written consent impractical" ,
(64. 06)
Certainly it is not impractical to secure consent petitions for the apartment rezoning
if the people are willing, since there are very few of them within 100 feet. The
question becomes one of impracticability and not of willingness. It is no secret
that the residents of this area whom I represent are opposed to a high rise develop-
ment, cutting off acce s s to their view, air, sunlight, etc. ,

This procedure, though inadvertently accomplished, is an attempt on the part of a
private developer to obviate a consent petition which is contra to the statutory
rights of the homeowners.
This type of study has not, nor should not ever be used for spot zoning as it i.s being
used now to thwart legal homeowners from protesting and determining the type of
development that shall occur next to tl�eir homesteads. I know of no precedent in
which the Council has used the 40 acre rule to further the interests of a private
developer in a spot zoning, To adopt such a course would be highly dangerous
and prejudicial to the rights of all homeowners throughout the city. It may interest
you to know that many of the neighbors desired to buy these lots individually to
build their homes, but were denied this right due to the block sale of lots when
offered for sale by the county after the city released them upon termination of
construction on Shepard Road. At that time these residents were given assurance
by the Council that the zoning would remain residential, and now this attempt to
destroy their residential area.
I understand the Planning Board will submit a report to you, at which time I will
have further comments, either before your body or in written form. I would, how-
ever, like to point out this finding from the staff report: -
"Much area in the vicinity of Sibley Manor is currently in either 'Ct
Residence zoning or less restrictive. A sizeable area to the south and
west of Sibley Manor could be developed with apartments without a very
direct effect on the major sin€le-family residential areas. All the
major areas currently zoned 'At and 'B' Residence are, with few exceptions,
occupied by single-family homes which tend to have large lots. This is
particularly true in the area between Snelling Place and Rankin Street,
south of the Mil�vaukee Railroad spur track. The average lot size there
for the single-family homes is over 13, 000 square feet. Any rezoning
in this area to 'C' Residence would tend to seriously damage the
. existing residential character and amenity values in the area, 'f (Page 6j
One final point - your honorable body has already made a determination that the
40 acre rule �vas not applicable to the rezoning of Anchor Hospital, i, e. , it was
not impractical to get the signatures. How can the Council now entertain the
proposition that the small area in Youngman Avenue must be accomplished

My I husnbly suggest that the report of the Planning Board be studied and filed,
and no further action be taken. Any resolution to spot zone would, I believe,
be contra not only to the rights of the homeowners in this area; not only against
the provisions of the 40 acre rule; not only against the purpose of the 40 acre rule,
but more importantly, it would set a precedent for utilizing the 40 acre rule for
spot zoning, which would place every landowner in jeopardy throughout �the City
of 5aint Paul.

I am the owner of Lots 31 and 32, Block 12, Palisades Addition to St.
Paul. This co�prises the north�rest corner of Ste�rart and Rankin ivith
100 feet facing on Stet�vart and 140 feet facing on Rankin. I bought
this property July 12, 1967 from my nei�;hbor, r�taltor R. Petersen, who
lives at 2957 Arona Street, ?oseville . This is just aroL;nd the corner
from vrhere I live. It was my intention at that time to build tTnro du-
plex_es on this site. However, upon trying to secure financing for
same I found that �uilding and Loan Co�npanies were not interested in
financi.ng such structures or residences because of the proxima.ty of
cor�mercial properties such as Van Paper Company just across the street
east, Pdorthern States Pov,er Co�Dar�y on the southeast corner of Stev�rart
and Ra.nkin and the railroad rioht-of-way directly behind or just north
of this site.
But Twin City Federal looYed at this site a.nd said they would finance .
an 11 unit apartment which they said vaould be a more appropriate land
useo I had Home Design Center dravr plans for such an a�artment and
then contacted the people tivho would be my nei�hbors, but they would
not give their consent. So I nad to bive up this ideao
Some tixne last sum�er I vras called on by i�.:r.� Robert Harris, who is
President of Cons�ruction �argaineer, 302 University Avenue, St. Paul.
He was interested in a site to build a neiv one-story office buildi�g
without any in a.nd out traffic. I thoubht perha.ps these nei5hbors
would be interested in so:.�ethin5 like tnis, rather than an apartment
because we thou�;ht this tivould be about as close to residential as
could be. :�s. Harris tivas very enthusiastic about this and vras sure
there would ba no objections to a nice building of this type which
would give less traffic than an apart�ent house. Th.is is a nice
looking office building which would have blended in nicely even with
residential property, ar.d v�rould have served also as a buffer bet::een
residential and com:nercial. But after cre submitted it to them (the
nei�hbors) they vrould not give their consent, I even tried to bu.y
the duplex from u�,�alter Rucker on the southeast corner of Stes^rar� and
Rankin. Hovrevsr, after cor,tacting :.Finnesota FederaZ about a mortoage
on this property the�r would increase the loan only about �700,C0 a-
bove the present loan balance an d at a much higher rate of iriterest.
This, they explained, was because of the proxi.�nity of commercial pro-
perty. .
I do not see how a one-story office building or even an apartment

by as muah as one dollar. If ar�ything, it would appreciate -L-he value.
January 27, 1969 there was added an assess�ent of �644.30 by the City
of St. Paul for the improvement of Rankin Strset from Shephard Road to
�'test Sevarith Street.
I ha.ve come to the point where there is not a thing I ca.n do with this
corner axcept pay taxes and i,:mprovements. But more th�n this the City
of St. Paul is deprived of a lot of revenue fror� taxes if these vacant
areas cannot be improved. This can be done only if this area is rezon-
ed for an appropriate use, It is impossible to get a loan on a struc-
ture such as a duplex or residence. .
