STAFF PRESENT: Jeff Hawkins, LIEP; and Jean Birkholz, City Council. Others present: Michael Thomas, President, and Allan Dahlen, Secretary, both of 16063 71�` Street NE, Otsego, Minnesota 55330. Ms. Moermond stated that this is a class N license which means that it needs to have notification of the neighbors. The City has received one (1) letter from District 6 Planning Council. She explained that at this informal hearing, she will develop a recommendation for the City Council to take action on the application of the license. There are three (3) possible tlungs the Council can do: 1) grant the license; 2) grant the license with conditions; or 3) recommend that the application go to an administrative law judge (if they don't believe that the license should be issued at all or if the applicant doesn't agree to the conditions that the Council thinks aze necessary Jeff Hawkins, LIEP, provided the'staff report. The license application is for auto repair garage. The applicant is Quick Precision Racing, Inc, 1014 Front Avenue. Environmental Health is not involved in this application. Fire has approved it. Licensing and Zoning haue approved it with conditions. LIEP's overall recommendation is approval with the following conditions: 1. In 2001, an applicant went before the Plamuiig Coxnxnission to re-estabiish the nonconforuiing use. There was a public hearing at that time, and there was no one in opposition. The building was originally built as an auto repair gazage and had that use for forty (40) yeazs. Because it had not been that same use for over 365 days, the use had to be re-established. This is a new licensee; a change of ownership, not a change of use. The applicants explained that they aze not offering a normal service garage business. Their customers do not come in for oil changes. They are a specialty service gazage - a hobby turned to a business. Customers come in for basic repairs from a standazd timing belt to complete restoration of a car, not including body work. Maintenance/modifying engines, drive-lines, etc. Their customers aze acquired by word-of-mouth; it's kind of like an owners' club. They do not use a lot of toxic materials. Ms. Moermond asked about their hours. The applicants replied that the hours will be 10:00 a.m. - 8:00 p.m. Monday through Friday; Saturday, by appointment only. Referring to condition #8: Customer vehicles may not be parked longer than ten (10) days on the premises. Ms. Moermond asked about customers leaving their vehicles with the garage and picking them up a couple weeks later. The applicants explained that the vehicies will be kept inside the gazage, not outside. They will not bring a car in for work until they actually have a physical bay open to work on it. With the pazking conditions that have been established, anything that would be pazked outside the garage longer than a day or two would hurt their individual customer parking. They do not want outside storage of vehicles. Ms. Moermond pointed out that in the letter she received, District 6 was concerned with the noise to the surrounding area residents, parking and the hours of operation. Ms. Moermond asked whether they planned to make a presentation to District 6 Planning Council. The applicants replied that they had been invited to make a presentation at the districYs January 28, 2004 meeting. Ms. Moermond expressed that it would be good public relations to take advantage of the opportunity to present this to the District Council. The applicants noted that the owner of the Half Tune Rec Bar across the street also owns the large lot on the west side of the building. Through the lease agreement, the applicants get two parking spots on the end up until 8:00 p.m. most nights and until a little eazlier on certain other nights. Parking arrangements with neighbors have also been made. The neighbors haue two (2) spots, one behind the other and the applicants have two (2) spots, one behind the other. If one person can't get out, they just need to knock on our door and the applicants will move a vehicle. Ms. Moermond suggested that a condition be added to the resolution stating that they will not be warking on cazs after 9 p.m. The applicants agreed. They noted that the air compressor will be turned off at 8 p.m. and that the hard core machining will be outsourced. 0�-Z�5 LEGISLATIVE HEARING - QUICK PRECISION RACING INC Page 3 Ms. Moerxnond again suggested that it would be to the applicant's advantage to make a presentation to the District Plauuing Council. They will have questions about noise and pazking, hours, etc. Ms. Moermond recommended that the license be issued with the conditions that were discussed.
