dwelling known. and described as
727-729 Marshall Avenue in the
City of Saint Paul and situated
upon those premises legally des-
cribed as Lot 8, Block 5,
Scribner and Crittendens Subdivi-
sion. of Lots 8 and 13 of Smith
and Lotts Out Lots, according to
the plat on file and of record in
the office of the Register of
Deeds in and for the Gounty of
Ramsey, State of Minnesota. �
WHEREAS, Pursuant to resolution, C. F. No. 242469,
approved March 6, 196g, a public hearing was duly held on
Tuesday, March 18, 196g, before the Council of the Gity of
Saint Paul , said hearing pertaining to the condition of the
structure located at 727-729 Marshall Avenue, Saint Paul,
A�i.�.nesota; and
WHEREAS, Upon the facts presented at the said hearing
consisting of photographs, inspection reports and the
recommendation of the City Architect, it is found and deter-
mined by the City Council that according to the records and files
in the office of the Register of Deeds, the last reoord owner
of the above-described property is Northern Federal Savings and
Loan Association; and that there are no other lien holders of
record; and that it is further determined that the above-
described building constitutes a hazardous building within
the definition of Minnesota Statutes Section 463. 15 for the
following reasons :

a. The building is standing vacant ,
abandoned and is subject to being entered by
unauthorized persons ;
b. The exterior condition of the building
is as �ollows : the two masonry chimneys show
evidence of the mortar being eroded �rom between
the bricks , causing them to be loose; the wood
exterior members on the building show evidence
of dry rot , and they must either be repaired or
replaced; this includes the siding, cornice
moldings, porch floor, porch joists , porch
supporting posts , windowsills and �rames ; the
limestone founda�ion shows evidence o� erosion
between the stones, causing them to be loose
and allowing entrance of vermin and possibly
rodents ; the exterior concrete block supporting
one of the front porch posts is tipped due to
settlement; the front porch concrete steps
have split through the middle and are badly
deteriorated;
c. The interior condition of the building
is as follows : the interior has evidence of
extreme settling in the �loors , one example
being that a header supporting several of the
floor joists has sagged to the point that the
joists that butt into the header are open
approximately one inch at the bottom; the
ceiling plaster is loose and falling; the
plumbing system has been stripped and removed
by vandals , as has the heating system; and
there is an open sewer connection in the second
floor east bedroom allowing sewer gas to enter
the building along with rats;
d. The building in the above condition
is beyond reasonable repair;
e. The building is unfit for human
habitation in its present condition and the
above corrections must be made in compliance
with the Building Code and the Housing Code
of the City of Saint Paul in order to make
the same habitable;

f. The building constitutes a nuisance
and a hazard to the public health, safety and
welfare because of its physical damage,
dilapidation and inadequate maintenance;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes
Sections 463. 15 through 463. 26, and based upon the foregoing
findings of the City Council , the Oouncil of the City of
Saint Paul does hereby make the following Order:
ORDER
1. .The o�rn.er of the above-described building shall make
the same safe and not detrimental to the public peace, health,
sa�ety and welfare by having the said building razed and the
materials therefrom removed from the premises within thirty (30)
days from the date of the service of this Order. �
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the office of the Clerk of the District Court o�
Ramsey County, Minnesota, within twenty (20) days fromthe date
of the service of this Order, a Motion for Summary Enforcement
of this Order to raze and remove the said building will be
made to the Ramsey County District Court.
3. In the event that the building is to be razed by the
City of Saint Paul pursuan.t to judgment of the District Court ,
all personal property or fixtures which may unreasonably inter-
fere with the razing and removal of this buildin.g shall be
removed within ten. (10) days from the entry of judgment; and
if not so removed, the City o� Saint Paul shall remove and
dispose of such personal property and fixtures as provided by
1 aw.

4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by
the City will be assessed against the above—described real
estate and collected as other taxes; and be it
FURTHER RESOLVED, That a certified copy of this resolu—
tion and incorporated Order herein be served upon the last
record owner of the above—described property in the manner
provided by law.

Re: File No. 1919-- 727-729 Marshall Avenue
Gentlemen:
The Building Department is hereby submitting its report on the
condition of the property known as 727-729 Marshall Avenue, a fourplex of
frame construction, two stories in height, full basement, being approximately
38 ft. wide, 63 ft. long and 30 ft, high. The owner of record is Northern
Federal Savings and. Loan Association, and. the legal description of the property
is Lot 8, Block 5, Scribner and Crittendens Subdivision of Lots 8 and 13 of Smith
and Lotts Out Lots.
There are no accessory buildings on the property. The building has
been vacant for a long period of time. At one time it had been made secure;
however, our file contains numerous reports that the building has been broken in-
t o, the most recent being January 27, 1969, when our inspector found the rear
wind.ow broken and open and. tracks in the snow indicating considerable traffic
into the building.
The following is a list of substand.ard items in the building noted
by our inspector:
EXTERIOR. The two masonry chimneys show evidence of the
mortar being eroded from between the bricks, causing them to be loose. The
wood exterior members on the building show evidence of dry rot, and they must
either be repaired or replaced. This includes the siding, cornice moldings, porch
floor, porch joists, porch supporting posts, windowsills and frames. The limestone
foundation shows evidence of erosion between the stones, causing them to be loose
and allowing entrance of vermin and possibly rodents. The exterior concrete
block supporting one of the front porch posts is tipped due to settlement. The
front porch concrete steps have split through the middle and are badly deteriorated.

FIRST FLOOR. The first floor contains two four-room
units wi th bath. Both kitchens and bed.room floors are sagging. Evidence
of plumbing leaks on the second floor have caused the ceiling plaster to
loosen and fall. The living rooms also show evidence of extreme sag.
SECOND FLOOR. Contains two four-room units with bath.
In the east apartment, the living room floor is sagging and in the west
apartment all the floors are sagging with the bedroom ceiling plaster falling
in some areas due to a leak in the roofing.
The plumbing system has been stripped and removed by
vandals, as has the heating system. There is an open sewer connection
in the second floor east bedroom allowing sewer gas to enter the building
along with rats.
We have been in contact with the Housing Authority and they
indicate in a letter to us on January 21, 1969 that this property has been
termed substandard and recommend acquisition during the proposed 5ummit-
University Urban Renewal activities . However, the property is not on the
early land acquisition program and it could therefore be a long time before
it is acquired.
Inasmuch as a rehabilitation schedule has not been submitted
by the owner, it is the conclusion of the Bureau of Public Build.ings that by
reason of inad equate maintenance, dilapidation, physical damage, unsanitary
condition and abandonment, the above structure constitutes a hazard to
public health, safety and welfare. It is hereby recommended that the Council
concur in this conclusion and refer the matter to the City Attorney's office
for submission of this condemnation to the District Court.
