Morgan Trail, to the HRA-owned "Head House" property located in the vicinity of Spring Street and Chestnut Street in 5aint Paul, also shown on the attached drawing (E�ibit "B"), a copy of which is on file in the Department of Public Works, Real Estate Division, File Number 39-2004; and WHEREAS, the City of Saint Paul, Aivision of Parks and Recreation ("Pazks") has granted permission to the HRA for said properry rights, as stated in the Saint Paul Pazks and Recreation Commission's Resolution Numbered 04-24, adopted December 8, 2004, a copy of which is attached hereto; and WHEREAS, the HRA must enter into a license agreement with the City of Saint Paul for the conshuction and continued maintenance and repair of the retaining wall, and must also enter into a license agreement for access to the "Head House" property by pedestrians and delivery and maintenance vehicles;and WHEREAS, appraisals of said park land areas have been performed by a qualified independent appraiser and appraised market values of the properties have been determined; and WfIEREA5, in accordance with Chapter 51 of the Saint Paul Administrative Code, the HRA has submitted to the City a proposal to exchange said park land with IIRt�-owned property located at 465 Wacouta Street (aka the "Wacouta Commons" property bounded by Wacouta/Sibley/8th/9th, as shown on the attached map, E�tibit "C"), and determ3ned by the City's Valuation & Assessment Engineerto be of greater value than said park land; now, therefore be it RESOLVED, that the Saint Paul City Council hereby accepts the H12A "Wacouta Commons" property in exchange for said diversion of pazk land on the Samuel H.
