1 BE IT RESOLVED, that, upon the petition of the City of Saint Paul (City), as documented in Real
2 Estate Division File Number 24-2004, the City's interest in public properiy hereinafter described is
3 hezeby vacated and discontinued as public property:

5 The properties being vacated are described as follows: SEE EXHIBIT "A"

7 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislative Code as amended, and to the following conditions:

10 1. That a permanent right-of-way easement shall be retained by the petitioner (City), on, over, under
11 and across the southeriy described property being vacated as referenced in Exhibit "A", on behalf
12 of the City of Saint Paul, Department of 1'ublic Works.

That, on behaif of the Board of Water Commissioners, a permanent utility easement shall be
retained on, over, under and across the vacated property to service any existing water utility
facilities. This reserves the right of the Board of Water Commissioners to maintain and operate
said existing water facilities in, on or under said easement, and to enter upon said easement or
any portion thereof at any time, and from time to time, for the purposes of future reconstruction,
inspecting, maintaining or repairing the same or any part thereof. Any development or use of the
property within the said utility easement shall be subject to the following restrictions stated in the
attached Eathibit "B".
That, at the recommendation of the City of St. Paul, Department of Planning and Economic
Development, any un-platted property being released of its City interest, be conveyed to the
Housing and Redevelopment Authority of St. Paui for future development.
A permanent easement shali be retained by District Energy/District Cooling for facilities on the
southerly described property being vacated along with a11 other existing easements in the azea
held by this utility.
A permanent easement shall be retained by Xcel Energy Electric on the east fifteen feet and the
west ten feet of ail portions of the vacated property for its existing facilities.

2 6. A permanent easement shall be retained by Comcast of St. Paul over ail vacated areas. Any
3 relocation of Comcast facilities will be at the cost of petitioner, ats successors or assigns.

'I`hat with any conveyance of the vacated properry, the grantee, their successors and assigns,
agree to indemnify, defend and save harmless the City of Saint Paul, its officers and employees
from all suits, actions or claims of any chazacter brought as a result of injuries or damages
received or sustained by any person, persons or property on account of this vacation or grantee's
use of this property, including but not limited to, a ciaim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from any
violation of any law or regulation made in accordance with the law, whether by the grantee or
any of their agents or empioyees.
17 9. That the petitioners, their successors and assigns shall, within 60 days of the ef£ective date of this
18 resolution, file with the City of 5t. Paul, Department of Public Works, an acceptance in writing
19 of the conditions of this resolution and shall, within the period(s) specified in the terms and
20 conditions of this resolution, comply in all respects with these terms and conditions.

That a permanent utility easement shall be retained on, over, under and across the vacated azea
on behaif of the Boazd of Water Commissioners of the City of Saint Paul to reserve the right of
the Board to maintain and operate any water facility in or upon said easement and to enter upon
said easement, or any portion thereof, at any time and from time to time, for the purposes of
future construction, reconstruction, inspection, maintenance or repair of the sazne, or any part
thereo£ Said utility easement shall be subject to the following reguirements:
a. No buildings, structures, trees or any temporary structure, material storage, fixture,
or any other objects which may prohibit normal access to water facilities for
maintenance purposes will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the Board
from exercising its reserved rights may be aliowed by obtaining written pernussion
from Saint Paul Regional Water Services with the understanding that the restoration
and costs of such improvements sha11 be the sole responsibility of the petiuoner, its
successors and assigns in the event the Board exercises its reserved easement rights.
c. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a resuit of Saint Paul Regional Water Services operations, all removal,
replacement or modificalion costs shall be borne solely by the petitioner.
d. No change from the existing grade within the easement area shall be permitted
without written permission from Saint Paul Regional Water Services.
e. No change in surfacing within the easement azea shall be pernutted without written
pernussion from Saint Paul Regional Water Services.
£ The petitioner, its successors and assigns shall fully indemnify, defend, and save
hazmless the Boazd of Water Commissioners of the City of 3aint Paul, lts officers,
agents, employees, and servants from all suits, actions or claims which shall arise
from any injuries or damages received or sustained by any break in any service pipe,
water main, or connection in said reserved easement, arising out of or resulting from
any action or negligence of the petitioner, its employees, agents or, business invitees.

Xcel Energy owns and operates a 2 inch gas main in the vacated Sibfey Street and in the
proposed area to be vacated. A minimum twenty (20) foot wide pertnanent easement shail
be retained to protect the interest of Northem States Power Company d.b.a. Xcel Energy.
The easement requirements shall include the following:
a. No buifdings or other permanent sttuctures are permitted within the easement area;
b. Reasonable access to said easement; and
c. Righf to enter upon said easement at any time, and from time to time for the purposes of
future construction, reconstruction, inspection, maintenance or repair of said gas facilities.

The Department of Public Wor4cs does not object to the vacation of the norther{y portion of "Parcel
2 along I-94, but we object to the vacation of the southeriy portion of "Parcel 2." This 7.5 foot strip
was previously retained by the City for Tenth Street right-of-way and we would like to continue to
keep this for Tenth Street right-of-way.
ff just the northern piece is vacated that will change the vacation description, They described the
proposed vacated areas in a very convoluted way, so you can't easily exctude the southeriy portion
of Parcel 2.
