That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Corporation.

I am requesring a date of December 22, 2004 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to approve the petition of Martin Art
Bustad to vacate a portion of West Idaho Avenue I have enclosed photocopies of the
Green Sheet, the Council Resolution and a map of the area to be vacated. Please let me

The Departrnent of Public Works has compieted a review of the above
referenced vacation and has no objections subject to the following
conditions and comments:
1) Property owners abutting the alley need to provide each other with
private easements as needed to serve properties which use the alley for access.
2) Use the following as the description on the vacation resolution:
Beginning at the northwest comer of Lot 30, Block 8, EDWIN M, WARE'S
CUMBERLAND ADD1TiON PLAT 1, according to the plat on file and of record in
the O�ce of the County Recorder, Ramsey County, Minnesota, thence
Easterly along the north line of said Block 8 to the northeast corner of
Lot 1, in said Block 8, thence Northerly along the westerly right of way
line of Western Avenue to the southeast corner of Lot 5, Block 1 of said
EDWIN M. WARE'S CUMBERLAND ADDIflON PLAT 1; thence Westerly along the south
line of said Block 1 to the southwest corner oF said Lot 5, Block 1; thence
Southeriy along the easterly right of way line of Cumberland Street to the
point of beginning and there terminating.
Also, the entire alley in Block 8 as dedicated in the plat EDWIN M. WARE'S
CUMBERLAND ADDITION PLAT 1, according to the plat on file and of record in
the Office of the County Recorder, Ramsey County, Minnesota.
3) ]ust so you know, there are existing power lines and poles in the alley
which will require easements to be retained.
4) They will want easements released in all or part of Cumberland Street
because they intend to build in that area. We are wiliing to release our
easements within all of the areas to be vacated. Please send me a
certificate of intended non-use using the above descript+on so I can
process it..
