Dear Sir:
This is written in response to the application of L. J. Boler for a
permit to remodel and enlarge an existing filling station. The applicant
proposes to add two pump islands on property adjoining an existing car wash
and filling station operation. The property proposed for new construction
is located on the north side of Idaho Avenue west of Wnite Bear Avenue and
is described as the west 150 feet of the east 288.5 feet of the south 90
feet of that part between California and Idaho Avenues of Lot 1, Kerwin's
Outlots.
This application was first considered by the Board of Zonin,g on
October 3, 1968 at which time the Board recommended denial. Tne City Council
returned this matter to the Zoning Board on October 24, 1968 after the
applicant stated that he understood that a median barrier was to be constructed
on White Bear Avenue prohibiting mid-block left turn movements.
Tnis matter was again before the Board of Zoning for consideration on
Pdovember 21, 1968. The applicant, however, requested that his application
be laid over to permit him to submit new plans.
At the December 5, 1968 Board of Zoning meeting the staff reported
that the site meets required design standards for this type of operation,
that traffic considera�ions nave met with approval, and �hat current zoning of
the site allows this use. However, the proposed use will increase traffic on
area minor residential streets and may be detrimental to the residential area
to the west. A letter from the Housing and Redevelopment Authority was noted
which requests carefuZ consideration be given in terms of the effect the
proposed use may have on housing in the surrounding area. The letter also
noted that there will be a large public expenditure in housing for the elderly
across Idaho Avenue, will be subject to noise and glare from the proposed use
and, further, that any increase in traffic on Idaho Avenue will endanger
elderly tenants walking to shopping facilities and churches.
Mr. Boler and Mr. Tom Rooney, his attorney, stated that the proposal will
provide safer traffic movements for people coming to the car wasn and in response

to a question from the Board said that some of the cars stored on the site are
awaiting repair from a separ�te concern located in his structure but that this
concern will be moving. Mr. Boler said that he is willing to eliminate the
westerly driveway on Idaho Avenue and limit access on this site to entrance
only. Mr. Joseph Willems, the adjacent property owner to the west, again
objected to the proposal and stated that there are three filling stations
at this intersection and that customers are presently driving over the side-
wa]ks on Idaho Avenue.
After further discussion, the Board of Zoning �roted to recommend denial
of this application reaffirming their previous recommendation.

A. HISTORY: A permit for a carwash was approved in October 1962 and a permit was �
granted for filling station in conjunction witn the carwasn in August, 1967 on
, a site north and adjoining the site in this application. The Zoning Board
recommsnded denial of the special-use permit on Octo�er 3, 1968. The City
Council referred tne matter back to the Zoning Board on October 24, 1968.
B. AREA ZOi1ING: North, east and south is zoned Commercial. i�est is "A" Residzr.ce
and southwest is zoned "C" Residence.
C. DESIG:I STANDARDS: It is proposed to install two gasoline dispenser islands to
be used in conjunction with the carwash adjoining to the north. The location
of the islands and tn� surfacing adjacent to tne islands conforms to d°sign
standards, 7" class "A" concrete. The rest of the area is to have a bituminous
surface. Poured concrete curbing will be installed adjacent to the sidewalk
and the buffer area to the west and along the property line at the east. The buffer
'_ � area will have a louvered fence and screen plantings. The proposed driveways
from Idaho Avenue are to be 32 feet wide.

This is written in response to the application of L. J. Boler
for a permit to remodel and enlarge an existing filling station
on property located on the west side of White Bear Avenue bet-
ween Idaho and California Avenues. The property is described
as the west 150' of the east 288.5' of the south 90' of that
part between California and Idaho Avenues of Lot 1, Kerwin's Out-
lots. The property i& zoned commercial.
At this time the applicant is operating a car-wash with gas pumps
at this site. He proposes to add additional pumps and access to
the facility from Idaho Avenue.
This matter was considered at the October 3, 1968 Board of
Zoning meeting. The staff reported the proposal meets the design
standards for this type of facility; that the Traffic Engineer
and Traffic and Safety Division have approved the plans; and that
the proposed operation will not interfere with the planned Senior
Citizen High-rise building to the southwest. The plans for this
proposal as submitted to the Board need several changes.

Qpposition to the proposal was expressed by a neighbor who pointed out
that the applicant had originally proposed access from Idaho Avenue
but had been limited to ingress and egress from White Bear Avenue.
He also noted that there are several gasoline stations now in the area.
Consequently, the Board of Zoning recommends denial of this appli-
cation for a permit to remodel and enlarge an existing filling
station.
