This is an improved street with existing power poles within the vacated area. We have no objections subject to the following conditions. 1) The legal description to use should be as follows: That part of Galtier Street lying north of a line drawn from the southeast corner of Lot 1, Block 7, Rice Street Villas Subdivision of Iots 8-10-12-13 and the East 275 feet of 11, Walcotts Addition to Cottage Homes to the southwest corner ot Lot 5, Block 8, said Rice Street Villas Subdivision and lying south of the south right-of-way line of the Burlington Northern Santa Fe Railroad. 2) 7hat a permanent sewer easement shall be retain on, over, under and across the vacated area on behalf of the City of Saint Paul, Department of Public W orks. Said sewer easement shall be subject to the foflawing conditions: a. No buildings, structures, trees or any temporary structure,. material storage, fixture, or any other objectss�wwhich may prohibit normal access to utility facilities for maintenance purposes wili be permitted within the easement area. b. Improvements in or upon the above described easement that do not prohibit the City from exercising its reserved rights may be allowed by obtaining ivritten permission from the Department of Pubiic Works Sewer Division with the understanding that the restoration and costs of such improvements shall be the sole responsibility of the petitioner, its successors and assigns in the event the City exercises its reserved easement rights. c. � Should it be necessary that the petitioner's works or improvements be removed or damaged as a result of the Department of Public Works operations, all removal, replacement or modification costs shall be borne solely by the petitioner.
