That the petitioner's, their successors and assigns shall pay $600.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Northem States Power Company, d.b.a. Xcel Energy.
That a permanent utility easement shall be retained within the vacated area to protect the interest
Qf Qwest Corporation.
That the petitioners, their successors and assi�s agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or dama�es received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners ar any of their agents or employees.

I am requesting a date of December 22, 2004 for a Public Hearing to approve the attached
Council Resolurion. The purpose of the resolurion is to approve the petition of David
Thorton to vacate a portion of Galtier Street I have enclosed photocopies of the Green
Sheet, the Council Resolution and a map of the area to be vacated. Please let me know if
there is any additional information you might need.
The resolution is cunently being routed for signatures along with the responses from the
utilities and other pertinent information.

October 12, 2004
The Department of Public Works has completed a review of the above referenced vacation. This is an
improved street with existing power poles within the vacated area. We have no objections subject to the
following conditions.
1) The legal description to use should be as follows:
That part of Galtier Street lying north of a line drawn from the southeast corner of Lot 1, Block 7, Rice
Street Villas Subdivision of Iots 8-10-12-13 and the East 275 feet of 11, Walcotts Addition to Cottage
Homes to the southwest corner ot Lot 5, Block 8, said Rice Street Villas Subdivision and lying south of the
south right-of-way line of the Burlington Northern Santa Fe Railroad.
2) 7hat a permanent sewer easement shall be retain on, over, under and across the vacated area on
behalf of the City of Saint Paul, Department of Public W orks. Said sewer easement shall be subject to the
foflawing conditions:
a. No buildings, structures, trees or any temporary structure,. material storage, fixture, or any other
objectss�wwhich may prohibit normal access to utility facilities for maintenance purposes wili be
permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining ivritten permission from the
Department of Pubiic Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of the Department of Public Works operations, all removal,
replacement or modification costs shall be borne solely by the petitioner.
No change from the existing grade within the easement area shall be permitted without
written permission from the Department of Pubiic W orks Sewer Division.

e. No change in surfacing within the easement area shaii be permitted without written
permission from the Department of Public Works Sewer Division.
The petitioner, its successors and assigns shall fufly indemniiy, defend, and save
harmiess the City of Saint Paul, its officers, agents, employees, and servants from all
sufts, actions, or claims which shail arise from any injuries or damages received or
sustained by any break in any service pipe or connection in said reserved easement
arising out of or resuiting from any action or negligence of the petitioner, its empVoyees,
agents, or business invitees.
