04-1226Retum copy to: Real Estate Division 140 City Hall RESOLUTI�N CITY OF SAINT PAUL, MINNESOTA Presented By Re(erred To Committee: Date S�"� WHEREAS, To comply with the Metropolitan Council - Environmental Services method of charging local goveming bodies for Reserve Capacity Charges, the Saint Paul City Council, pursuant to Section 77.07 of the Saint Paul Legislative Code, adopted Resolution C.F. 260524 on January 23, 1973 (Chapter A-6 Administrative Code) as amended, which establishes Service Availability Charges (SAC); and 10 11 12 13 14 15 WHEREAS, The Metropolitan Council - Environmental Services has increased the unit chazges for the year 2005 from $1,350.00 to $1,450.00 per unit; now therefore be it RESOLVED, That Council Resolution C.F. 260524, adopted Januazy 23, 1973, as amended, be and the same is hereby fixrther amended so as to increase the SAC unit charge from $1,350.00 to $1,450.00 per unit for the year 2005; and be it FURTHER RESOLVED, That this amending resolution will take effect and be in force from and after its passage and approval. The new basic MCES SAC rate will be$1,450 for all Local Govemments. The MCES SAC rate to be paid by yow Local Govemment m MCES is the rate in effed at the rime of payment on the building or sewer cannection permit regazdless of when the permitting process began, The monthly 5AC report and payment aze due wit}un 30 days of the end of the month. Beginning in 2005, the Local GovernmenYs retainage of 1% of MCES SAC collecrions will only be allowed as a discount for prompt payment. I.ate zeports will forfeit this discount. SAC rate discounts aze a�ailable, with prior MCES approval, when multi-family developments include water consexvation feariues such as a central laundry, or if they are publicly subsidized low income units with no dishwashers or gazbage disposals. Yow community collects a local (or retail) SAC as users connect to the metropolitan wastewater system for the first time or as a user's potential or peak sewage increases. The MCES (ot wholesale) SAC is paid to the Council on the same basis. The SAC fuads we collect pay for the resenre capacity (unused) portion of the capital costs of the metropolitan was[ewater system as sp�ed in M�nn, Statutes section 473.517 (3).
