04-1224SUBSTITUTE CITY Presented by Council File #04-1224 Green Sheet #3024684 RESOLUTION SAINT PAUL, MINNESOTA �1 t wtit�:i�AS e City Council adapted Council File #04-459 on July 28, 2004, which authorized the City to demolish z proper[y at 956 Feronia Avenue if the owner failed to make repairs within 3Q days; and 3 WFIEREAS, Council File #04-459 was an effort to provide the owners of 1956 Feronia a second chance to remove or a repair this sttucture, which was considered to possess some azchitectural significance; and WHEREAS, the Srst chance was given in Council File #03-816 which granted the ownet 180 days for the rehabilitation of the structure;and 7 WHEREAS, the 180 day time petiod granted in Council File #03-816 concluded with no progress on the building and the 8 forfeitute of the $2,000 performance bond for lack of progress, and 9 WHEREAS, the owners were notified by a letter of October 21, 2004, that these thtee conditions, established by the vacant lo building program manager and ]egislative hearing officer, must be met in order for the Council to consider rescinding 1 i Council File #04-459 and grant the owner 180 days for the building's rehabilitation; these conditions being: t 2 1) providing the City c�plicit plans for rehabilitating the structure, 13 2) providing the City materials and documents demonstrating the financial capacity of the owners to execute these la plans, and 15 3) posting a perfornlauce bond of $25,000 by noon on December 22, 2004 (returnable upon project completion, if �s completed within 180 days, or 360 days if e�ctension granted); t7 WHEREAS, the owners have presented the Legislative Hearing Officer and Vacant Building Program Manager materials 78 on items 1 and 2 in a November 23, 2004 Legislative Hearing; now, therefore, be it �9 RESOLVED, the City of Saint Paul hereby amends Council File 04-459 and grants the owners, Naomi Isaacson and 2o Laureen Marie Ballinger, 180 days to complete the rehabilitation of the property, if the owners post the $25,000 21 perfonnauce bond in the Office of License, Inspection and E nvironmental Protection bv 4:30 p.m December 28 2004 22 23 2A 25 26 27 �g 9 AdoptedbyCouncil: Qate �'�-✓�'��' aa , a00/�— 0 Adoption By: Approved � Requested by Department of: By.
