of record in the office of the
Register of Deeds in and for the
County of Ramsey, State of Minne—
sota.
WHEREAS, Pursuant to resolution, C. F. No. 241028, approved
November 20, 1968, a public hearing was duly held on Thursday,
Deeember 5, 1968, before the Council of the Gity of Saint Paul,
said hearing pertaining to the condition of the structure located
at 427-441 West Seventh Street, Saint Paul, Minnesota; and
WHEREAS, Upon the facts presented at the said hearingeorl—
sisting o� photographs, inspection reports and the recommendation
of the City Architect, it is found and determined by the City
Council that according to the records and files in the office of
the Register of Deeds, the last record owner of the above—
described property is Mollie Alpert; that Mary Kohout is the
mortgagee and purehaser at foreclosure sale; and that there are
no other lien holders of record; and that it is further determined
that the above—described building constitutes a hazardous building
within the definition. of Minnesota Statutes S ction 463 15 for the
following reasons:

a. The building is standing vacant except
for one unit ;
b. The exterior condition o� the building
is as follows: the brick veneer over the frame
has fallen or been removed from all walls except
the front wall ; the walls are now covered with
an imitation brick asphalt siding; there is
evidence that the sheathing under the siding is
rotten as in one area the fire escape at the
second floor level has started to collapse the
subsheathin.g; the interior stairways are badly
worn and sagging; the exterior fire escapes do
not extend to the ground level ; the roof section
has been burnt through above the west apartment
and has been only temporarily repaired; the
brick front on the north wall has bulges which
indicate a failure in the structural supports;
many of the windows have been smashed by van.dals
and there is extensive rot to the exposed window
sills ;
c. The interior condition of the building
is as follows : the basement has a stone floor
an.d stone walls that are deteriorated due to the
mortar eroding from between the stones ; the wood
supporting posts have rotted at the bottom an,d
in the basement you can see out through the
rotted framing members in. many areas; the store
space at 427 has the plaster falling �rom the
walls , the floor is sagging and the stairs to
the basement are rotted and sagging� there was
water running across the floor into a hole in
a soil pipe in the basement; the plumbing system
is broken; the only heating available is through
a gas range; and the floor joists , which are
badly rotted, are given temporary support by
extra posts; the apartment at 429 has hallway
plaster cracked and falling; the stair has been
repaired by planks spiked on the treads , hand-
rails are missing; the plumbing system is leaking

into the hall; plaster is cracked and falling from
many areas within the apartment; heat is provided by
a stove; the space at 433 West Seventh, a five-room
apartment , has stair treads which are badly worn
and were replaced by planks spiked on top of the
worn treads; the plaster is cracked and falling;
handrails are missing; �loors are badly sagging
and the electrical system is inadequate; and
plumbing shows evidence of leaking; the apartment
at 439 has badly worn stairs , plaster is cracked
an.d falling; the stairway to the second and third
floor is sagging with the handrailings broken and
loose; the apartment on the third floor has been
- extensively damaged by fire; approximately 12 of
the ceiling joists measuring 16 feet have been
�: burned out, as have four of the window sash; and
the other apartments and shop space in the
building are the same as those previously men-
tioned, or worse;
d. The building in the above condition is
beyond reasonable repair;
e. The building is unfit for human habita-
tion in its present condition and the above
corrections must be made in compliance with the
Building Code and the Housing Code of the City of
Saint Paul in order to make the same habitable;
f. The building constitutes a nuisance and
a hazard to the public health, safety and welfare
because of its physical damage, dilapidation and
inadequate main.tenance;
now, there�ore, be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing �indings of the
City Council , the Council of the City of Saint Paul does hereby make
the following Order:

ORDER
1. The owner of the above—described building shall make
the same safe and not detrimental to the public peace, health,
safety and welfare by having the said building razed and the
materials therefrom removed from the premises within thirty (30)
days from the date of the service of this Order;
2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Glerk of the District Gourt of RamsEy
County, Min.nesota, within twenty (20) days from the date of the
service of this Order, a Motion for Summary Enforcement of this
Order to raze an.d remove the said building will be made to the
Ramsey County District Court;
3. In thc event that the building is to be razed by the
City of Saint Paul pursuant to judgment of the District Court,
all person.:�,l property or fixtures which may un.reasonably inter�
fere with the razin and removal of this building shall be
removed within ten �10) days from the entry of judgment; and if
not so removed, the City of Saint Paul shall remove and dispose
of such personal property and fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any
corrective action herein, all necessary costs expended by the
City will be assessed against the above—described real estate
and collected as other taxes; and be it
FURTHER RESOLVED, That a certified copy o� this resolution
and incorporated Order herein be served upon the last record
own:er of the above—described property in the manner provided by
law and also upon other interested parties in the manner provided
by law.

Re: File No. 1960--427--441 West Seventh Street
Gentlemen:
The Building Department is hereby submitting its report on
the condition of the property known as 427-441 West 5eventh Street, a
frame build.ing three stories in height with a full basement. It is
approximately 87 ft. long, 30 ft. wid.e and 30 ft. high. The building
contains four commercial occupancies on the first floor, four apartments
on the second floor and. four apartments on the third floor. At the
present time, the building is vacant except for the Beeler Cabinet Shop
at 431 W. Seventh. There has been a recent fire on the third floor,
which caused extensive interior damage to that apartment. The apartments
were posted by the Health Department as being unfit to live in as of
December 14, 1967.
The owner of record. is Mollie Alpert and the legal description
of the property is Part northwesterly of West Seventh 5treet of Lots 6
and 7, Block 9, Leech's Add.ition.
A recent inspection of the property ind.icates the following:
EXTERIOR. Originally brick veneer over frame. However, the
brick veneer has fallen or been removed from all walls except the front
wall. The walls are now covered. with an imitation brick asphalt sid.ing.
There is evidence that the sheathing und.er the siding is rotten as in one
area the fire escape at the second. floor level has started to collapse the
subsheathing. The interior stairways are badly worn and sagging. The
exterior fire escapes do not extend to the ground level. The roof s ection
has been burnt through above the west apartment and has been only

A strong smell of sewer gas ind.icates the plumbing system is broken. The
floor joists, which are bad.ly rotted., are given temporary support by extra
posts. The only heating available is through a gas range.
The apartment at 429 W. Seventh has hallway plaster cracked and.
falling. The stair has been repaired by planks spiked. on the treads, making
the stair unsafe to use. Handrails are missing. The plumbing system is
leaking into the hall. Plaster is cracked and falling from many areas within
the apartment. Heat is provided by a stove.
The space at 433 W. Seventh is a five-room apartment. The stair
tread.s, which are badly worn, were replaced by planks spiked on top
of the worn treads, making an unsafe stairway. The plaster is cracked and.
falling throughout. The handrails are missing. Floors are badly sagging
and the electrical system is inadequate. Extension cords were used for
outlets. Plumbing shows evidence of leaking.
The apartment at 439 W. 5eventh has badly worn stairs, plaster
is cracked. and falling from the walls and ceiling, the stairway to the second
and. third floor is sagging with the hand.railings broken and. loose. The
apartment on the third floor has been extensively damaged. by fire. The
front room has been burned out through the roof and into the cornice in the
front of the building. Approximately 12 of the ceiling joists measuring
16 ft. have been burned. out, as have four of the window sash.
The other apartments and. shop space in the building are the same
as those previously mentioned, or worse.
Inasmuch as a rehabilitation schedule has not been submitted
by the owner, it is the conclusion of the Bureau of Public Build.ings that
by reason of inad.equate maintenance, dilapidation, physical damage,
unsanitary condition and abandonxnent, the above structure constitutes a
hazard to public health, safety and welfare. It is hereby recommended.
that the Council concur in this conclusion and refer the matter to the
City Attorney's office for submission of this condemnati n to the District
Court. `
