04-1217Council File # �� � I�/ 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 Green Sheet # RESOLUTION C{TY OF SAINT PAUL, MINNESOTA Presented By. � Referred To " �/ Committee: Date December 6, 2004 WHEREAS, Neighborhood Housing and Property Improvement (NHP� has requested the City Council to hold public hearings to consider the advisability of revoking the rental registration certificate for a duplex rental property located at 548 VAN Bi.TREN AVE and registered toMoua Lee/Sheng Lee, and others, if listed; and WfTEREAS, on July 1, 2004, NIIPI conducted an inspection of said property and issued a Correcfion Notice with a compliance deadline of July 1, 2004 for Items # 1 and July 30, 2004 for Items #2, #3; and WHEREA5, on August 24, 2004, NHPI conducted a reinspection of said properiy and found lack of compliance with the previous order; and WHEREAS, on August 25, 2004, NIIPI sent a$75 excessive consumption bill to Moua LeeiSheng Lee addressed to 1975 Stanich Ct., the address on said certificate; and WHEREAS, as of November 19, 2004, said $75.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consuxnption is grounds for certificate revocation; and WHEREAS, on August 24, 2004, NHPI notified Moua Lee/Sheng Lee of the need to arrange an interior inspection of the subject property; and WHEREAS, as of November 19, 2004, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on September 13, 2004, NHPI conducted a reinspecrion of said property and found lack of compliance with the previous order; and WHEREAS, on September 14, 2QQ4, NHPI sent a$150 excessive consumption bill to Moua Lee/Sheng Lee addressed to 1975 Stanich Ct., the address on said certificate; and WHEREAS, as of November 19, 2004, said $150.00 has not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WIIEI2EAS, on November l9, 2004, NHPI sent Moua Leelsheng Lee the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEIZEAS, Moua Lee/Sheng Lee has not appealed said notice and the time for filing an appeal has expired; now therefore 3024546 ��/ - /a! 7 BE IT RESOLVED, that based on the foregoing, the Saint Paul City Counci hereby adopts the following findings and order concerning the subject property at 548 VAN Bi JREN AVE . 1 2. 3 � 5 That the subject property is a duplex family rental properiy that is required to be registered with the Cit�s Rental Registration Program. That the holder of the Rental Registration Certificate for the subject property is C/O Hudson Management. That said certificate holder has been billed for excessive consumption of code inspection services, which has not been paid. That said certificate holder has been requested to allow an interior inspection of the subject properly, which has not been arranged. That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. �'� • The Saint Paul City Council hereby makes the following order: 1. The above-referenced Rental Registration Certificate issued to Moua Lee/Sheng Lee for the duplex famaly rental property at 548 VAN BUREN AVE , Saint Paul, MN is hereby revoked. 2. St. Paul MN. You aze hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, of the City's intent to revoke the registration certificate for 548 VAN BLTREN AVE based on the foliowing: 2. As of today this $150.00 has not been paid. 9. On September 14, 2004, this depariment notified you again by mail of the need to arrange an interior inspection of said rental property. 10. As of today this interior inspection has not been arranged. I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13} days from the date of this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the hours of 8:00 a.m. and 4:30 pm. on any business day at the City Cierk's O�ce, Room 170, City Hall, 15 W. Kellogg Boulevazd, St. Paul, MN or you may appeal by mail within the same 13 day time line. Once the City Council has revoked the rental registration certificate, occupancy of the property is not allowed until (1) an inspection by Neighborhood Housing and Properry Improvement (NHPI) has been conducted, (2) the Director of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note: Renting a property without a certificate is a misdemeanor. Please call me as soon as possibie to arrange a meeting to discuss how to correct this situation before the City Council acts to revoke this certificate. If ail issues are addressed, I wiil recommend that the revocation be withdrawn from consideration by the City Council.
