WF3EREAS, Neighborhood Housing and Property Improvement (NI3Pn has requested the City
Council to hold public hearings to consider the advisability of revoking the rental registration certificate
for a commerciaUrental property located at 754 i1NIVERSITY AVE W and registered to May Pa Lee;
and
6 WHEREAS, on July 26, 2004, NHPI conducted an inspection of said property and issued a
7 Correction Notice with a compliance deadline of August I 5, 2004; and

WHEREAS, on August 30, 2004, NHPI conducted a reinspection of said properiy and found lack
of compliance with the previous ordex; and
WHEREAS, on September 29, 2004, NHPI sent the holder of the rental registration certificate
for the subject properry, May Pa Lee , a$75 excessive consumption biil, addressed to 1730 8th 5t N,
Sheboygan WI 53031-2734, the address on said certificate; and
WHEREAS, as of November 22, 2004, said $75.00 has not been paid, and Legislative Code
§51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate
revocation; and
WHEREAS, on September 29, 2004, NHPI notified May Pa Lee of the need to arrange an
interior inspection of the subject property; and
WHEREA5, as ofNovember 22, 2004, an interior inspection has not been arranged, and
Legislative Code §51 A7 (a) (iii) provides that the imposition of an excessive consumption fee is grounds
for an interior inspection; and
WHEREAS, on November 22, 2004, NHPI sent May Pa Lee the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WHEREAS, May Pa Lee has not appealed said notice and the time for filing an appeal has
expired; now therefore
BE IT RESOLVED, that based on the foregoing, the 5aint Paul City Council hereby adopts the
following findings and order concerning the subject properiy at 754 LINIVERSITY AVE W.
That the subject property is a commercial! rental properry that is required to be registered

with the City's Rentai RegistraYion Program.

That the holder of the Rental Registration Certificate for the subj ect property is May Pa
Lee.
That said certificate holder has been billed for excessive consuxnption of code inspection
services, which has not been paid.
That said certificate holder has been requested to allow an inierior inspection of the
subject pxoperty, which has not been arranged.
That the notification requirements of Chapter 51 have been fu1fi11ed and the time for an
appeal has expired without an appeal being made.

The Saint Paul City Council hereby makes the following order:
1. The above-referenced Rental Registration Certificate issued to May Pa Lee for tha
commericaU rental property at 754 LTNIVERSITY AVE W, Saint Paul, MN is hereby
revoked.
2. It is further ordered that a copy of this resolution be mailed to May Pa Lee .

I am writing to you in your capacity as the holder of a rental registration certificate for 754 UNIVERSITY AVE
W, St. Paul MN.
You are hereby notified, parsuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registrafion certificate for 754 UNIVERSITY AVE W based on the
following:
On July 26, 2004, this department conducted an inspection of said property and issued a
Correction Notice with a compliance deadline of August 15, 2004.
2. On August 30, 2004, this department conducted a reinspection of said property and found lack of
compliance with the previous order. An Excessive Consumption bill was sent with a compliance
date of September 21, 2004.
On September 29, 2004, this department conducted a reinspection of said properiy and found
lack of compliance with the previous order.

On October 1, 2004, this department sent you a$75.00 bill for the cost of said reinspection.
As of today this $75.00 has not been paid.
On October 1, 2004, this department notified you by mail of the need to arrange an interior
inspection of said rental property.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council �ith a recommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of

this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appearing in person between the
hours of 8:00 a.m. and 430 pm. on any business day at the City Cierk's Office, Room 170, City Hall, 15 W.
Kellogg Boulevazd, St. Paul, MN or you may appeal by mail within the same 13 day time line.
Once the City Council has revoked the rental registration certificate, occupancy of the properiy is not allowed
until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (2)
the Director of NI-IPI has deteilnined the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a properiy without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City
Council acts to revoke this certificate. If all issues are addressed, I will recommend that the revocation be
withdrawn from considerarion by the City Council.
