1 WHEREAS, Neighborhood Housing and Properry Improvement (NHPI} has requested the City
2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a duplex rental properry located at 1360 TAYLOR AVE and registered to Andrew L. Dick ; and
WHEREAS, on October 1, 2004, NHPI conducted an inspection of said properry and issued a
Summary Abatement Order with a compliance deadline of October 10, 2004; and
WHEREAS, on October 11, 2004, NHPI conducted a reinspection of said property and found

lack of compliance with the previous order; and
WHEREAS, on October 13, 2004, NHPI sent the holder of the rental registration certificate for
the subject property, Andrew L. Dick , a$50 excessive consumption bill, addressed to 1099 Scarborogh
Lane, Woodbury MN 55125, the address on said certificate; and
WHEREAS, as of November 22, 2004, said $50.00 has not been paid, and Legislative Code
§51.06 (a) (v) provides that non-payment of fees for excessive consuxnption is gromids for certificate
revocation; and
WHEREAS, on October 13, 2004, NHPI notified Andrew L. Dick of the need to arrange an
interior inspection of the subject property; and
WHEREAS, as of November 22, 2004, an interior inspection has not been arranged, and
Legislative Code §51.07 (a) (iii) provides that the imposition of an excessive consumption fee is grounds
for an interior inspection; and
WHEREA5, on November 22, 2004, NHPI sent Andrew L. Dick the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WHEREAS, Andrew L. Dick has not appealed said notice and the time for filing an appeai has
expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
foliowing findings and order concerning the subject property at 1360 TAI'LOR AVE .
That the subject property is a duplex rentai properry that is required to be registered with
the City's Rental Registration Program.

2. That the holder of the Rentai Registration Certificate for the subject property is Andrew
L. Dick .
That said certificate holder has been bilied for excessive conswnption of code inspection
services, which has not been paid.
That said certificate holder has been requested to allow an interior inspection of the
subject property, which has not been arranged.
That the notification requirements of Chapter 51 have been fu1fi11ed and the time for an
appeal has expired without an appeai being made.
The Saint Paul City Council hereby makes the following order:

The above-referenced Rental Registration Certificate issued to Andrew L. Dick far the
duplex rental property at 1360 TAI'LOR AVE, Saint Paul, NIN is hereby revoked.

I am writing to you in youx capacity as the holder of a rental registration certificate for 1360 TAYLOR AVE ,
St. Paul MN.
You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 1360 TAYLOR AVE based on the
following:
On October l, 2004, this department conducted an inspection of said property and issued a
Summary Abatement Order with a compliance deadline of October 10, 2004

On October 1 l, 2004, this depariment conducted a reinspection of said property and found lack
of compliance with the previous order.
On October 13, 20Q4, this department sent you a$SQ.00 bi11 for the cost of said reinspection.
As of today this $50.00 has not been paid.
On October 13, 2004, this department notified you by mail of the need to arrange an interior
inspection of said rental property.
As of today this interior inspection has not been arranged.
I have refened this matter to the St. Paul City Council with a recommendation to revoke the rental registration
certificate. The City Councii will revoke unless an appeal is filed in the next thirteen (13) days from the date of
this notice. An appeal may be filed pursuant to legislative Code § 18.02, by appeazing in person between the
hours of 8:00 a.m. and 430 p.m. on any business day at the City Clerk's Office, Room 170, City Hall, 15 W.
Keliogg Boulevard, St. Pau1, MN or you may appeal by mail within the same 13 day time line.

Once the Cit}� Council has revoked the rental registration certificate, occupancy of the property is not allowed
until (1) an inspection by Neighborhood Housing and Properry Improvement (NHPn has been conducted, (2)
the Director of NHPI has detennined the properiy to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to conect this situarion before the City
Council acts to revoke this certificate. ff all issues aze addressed, I will recommend that the revocation be
withdrawn Hom consideration by the City Council.
